Honor Cesar Chavez’s Legacy by Confronting UFW Corruption

Chavez Spent His life Trying to Improve Farm Worker’s Lives, Instead of Threatening Their Lives

Cesar Chavez spent his life trying to improve life for farmworkers, fighting for changes he felt would bring about civil rights and justice for workers. At the end of this month, California state legislators plan to honor Cesar Chavez’s birthday as a day of public service.

The work Cesar Chavez did organizing farmworkers is credited with spurring better working conditions and increased wages, putting people who perform difficult work but still struggle to provide for their families a step closer to achieving the American Dream in California.

Cesar Chavez has been portrayed as the founder of The United Farm Workers union to help struggling farm workers achieve a better life.
Growing up in the fields in the Central Valley town of Delano, this fight begun by Cesar Chavez is personal to me. I too come from an immigrant background, I’ve eaten with the farmworkers who fought alongside Cesar Chavez and heard their stories.

Today, however, Cesar Chavez would be saddened to see what the UFW has become.

After voting overwhelmingly to leave the UFW, Gerawan farmworkers spent five long years in court fighting the UFW and the ALRB, who refused to count their votes until they were ordered to by a judge.
The Gerawan workers, just like the farmworker activists before they were fighting for a better life – and against a UFW contract that would have lowered their pay.

While in Cesar Chavez’s time the UFW gave farmworkers a voice, today’s UFW instead seeks to silence the workers.

When Gerawan farmworker activist Silvia Lopez, one of the leaders of the fight to leave the UFW, tried to speak with former Governor Jerry Brown, a top UFW leader physically blocked her way. The whole incident was captured on video and reported by the Sacramento Bee.

Cesar Chavez spoke out against humiliation and oppression, such as the methods of today’s UFW bosses.

The Gerawan farmworkers are far from alone. Today, the UFW represents just 1 percent of farmworkers, and more petition the ALRB to leave all the time. As reported by the Los Angeles Times, former ALRB Chairman William B. Gould IV, who resigned from the agency in disgust, stated the ALRB now spends more time on petitions from workers trying to leave the union than those trying to join.

In fact, the UFW even abuses its own workers, who the Los Angeles Times reported had to take the union to court to force the union to pay almost $2 million in unpaid wages and penalties.

Cesar Chavez devoted his life to fighting for workers rights. He supported workers right to choose whether or not to join a union. Civil rights for farmworkers cannot be achieved when the government looks the other way when workers are abused, regardless of who is committing the acts of oppression.

That’s why we cannot honor Cesar Chavez’s legacy without speaking out against the abuses of today’s UFW.

ALRB/UFW Access Update Meeting March 21 in Bakersfield

Jesse Rojas, the founder, and CEO of The Redd Group; Michael Saqui from the Saqui Law Group; and Raul Calvo from Employer Services are the presenters of an upcoming important seminar. It will specifically focus on agriculture and farm labor contractors,  growers, packers, and shippers, regarding ALRB and UFW access. Attendees will learn what to do when the United Farm Workers union is wanting to take access and speak with farm employees to try to unionize them.

“The reason why we wanted to do this now before the season started is that the UFW has been very active this year, said Rojas. “The union is trying to get out of the hole that they’ve been in after so many losses. They pulled a big PR stunt earlier this year at Wonderful in Delano, and we also heard that they’re continuing to hire multiple organizers, which indicates that they’re trying to get more active in our industry this year.”

The dos and don’ts will be discussed when it comes to the union trying to take access to your employees or trying to gain access in your fields. Saqui will be presenting his hot topics in labor and employment. He will also delve into the overtime pay in agriculture, which is confusing and ever-changing.

“Raul Calvo will speak about how to improve employee relations and communications with your employees out in the field and avoid having a third party attempt to step in and become the medium of communication between you and your employees,” Rojas said.

State Senator Shannon Grove will also be speaking at the event at 8:30 in the morning, and she will be focusing on some of the legislation—the good and bad law that’s currently happening at the capital that’s going to affect agriculture.

“She will also speak about the general overreach of state agencies such as the ALRB,” Rojas said.

First-Ever UC Cost Study for Primocane-Bearing Blackberries Released

Primocane-Bearing Extends Production Season

The first-ever cost study of primocane-bearing blackberries in California has been published by UC ANR’s Agricultural Issues Center and UC Cooperative Extension. With primocane-bearing, growers can extend the blackberry production season.

“What differentiates primocane-bearing blackberry from the traditional floricane-bearing is that it bears fruit in the first year rather than the second,” explained co-author Mark Bolda, a UC Cooperative Extension advisor.

“Which, of course, opens a world of opportunity for growers, since they are able to produce fruit in the first year rather than the second, as has traditionally been the case,” Bolda said. “That’s what makes this study so interesting to us.”

Primocanes are the green, vegetative stalks of the blackberry plant, generally the first-year cane. The second year, they become floricanes, flowering and fruiting. 

The study presents sample costs to establish, produce, and harvest primocane-bearing blackberries in the Central Coast region of Santa Cruz, Monterey, and San Benito counties.

The analysis is based on a hypothetical well-managed farming operation using practices common to the region. The costs, materials and practices shown in this study will not apply to all farms. Growers, UC ANR Cooperative Extension farm advisors, and other agricultural associates provided input and reviewed the methods and findings of the study.

This study assumes a farm operation size of 30 contiguous acres of rented land, with primocane-bearing blackberries for fresh market planted on 15 acres. The crop is hand-harvested and packed into 4.5 pound trays. During the establishment year, there is a four-month harvest: July through August. Primocane blackberries can produce fruit on first-year growth. There is also a four-month harvest for each of the four production years.

The authors describe assumptions in detail and present a table of costs and returns based on those assumptions about production, input materials, prices, and yields. A ranging analysis shows the impact on net returns of alternative yields and prices. Other tables show the monthly cash costs; the costs and returns per acre; hourly equipment costs; and the whole farm annual equipment, investment, and business overhead costs.

The study also has an expanded section on labor, which includes information on California’s new minimum wage and overtime laws.

“This work investigating the economics of a newer cultural system for our area came out of a close collaboration between UCCE academics and area growers,” said Bolda, who serves Santa Cruz, Monterey and San Benito counties, “so the level of detail and accuracy is outstanding.”

Roger Isom: Probable Electric Rate Hikes Raise Concern for Ag

California Agriculture Concerned Over PG&E Increases, Overtime Rules

Water, labor, and air quality issues in California keep growers’ plates full of challenges, but with probable PG&E rate increases in the future, it seems they can’t catch a break. Roger Isom, President and CEO of the Western Agriculture Processors Association and California Cotton Ginners and Growers Association, is among those wondering how the industry is going to compete.

“We’ve been paying for a lot of those safety upgrades. What happened? I mean, we’ve got to let the investigation take place, but to saddle rate payers with that amount of money, we just can’t do it,” Isom said of the threat of rate increases.

At the same time, the industry is still battling the effects of the Brown administration’s ruling on overtime.

“There are farm workers in 45 states that could work 20 hours a day, seven days a week, and never trigger overtime. We have to compete with that, and that’s just unacceptable,” Isom said.

Isom is optimistic about new appointments in California administration, though.

“You’ve got Jared Blumenfeld, who’s the new CalEPA Secretary. He was actually extremely helpful over there when we were working on incentives for replacing pumps and tractors,” Isom explained.

Isom also gave credits to Wade Crowfoot, who was on the previous administration and helped with port shutdowns.

“He’s going to hit up resources, which obviously with the water situation is a very critical agency for us. Seeing somebody over there that could be helpful is important,” he said.

OSHA 300A Log Posting Due Feb. 1

OSHA Log Summary Must Be Posted in Common Areas

OSHA’s Form 300A logs with work-related injuries and illnesses occurring in the prior calendar year must be posted. All eligible employers are required to maintain and post an annual OSHA 300A summary sheet from February 1 to April 30.

February 1 marks the deadline for you to tabulate your annual OSHA Log Summary (OSHA Form 300A) and post it in a common area wherever notices to employees are usually posted. The summary must list the total number of job-related injuries and illnesses that occurred during the previous calendar year and were logged on the OSHA 300 Form. The summary should remain posted until April 30. Instructions on how to complete both the log and annual summaries of work-related injuries and illnesses can be downloaded for free from Cal/OSHA’s Record Keeping Overview. The definitions and requirements for recordable work-related fatalities, injuries and illnesses are outlined in the California Code of Regulations, Title 8, sections 14300 through 14300.48. Employers are required to complete and post Form 300A even if no workplace injuries occurred.

Employers with 10 or less employees or who work in low-hazard industries are not required to post their summary. Additional details regarding eligibility for the exemption can be found on the OSHA Injury Tracking Application webpage.

Electronic Reporting Requirement

Additionally, many employers are required to also submit their OSHA 300A information electronically. The classes of business who must comply with the electronic reporting process include:

  1. Any business with at least 250 employees.
  2. Any business with 20 to 249 employees who falls into one of several classifications including agriculture. (A complete list of the affected classifications can be found here.)

Affected employers are advised to submit their 2018 OSHA 300A data through the Fed-OSHA portal by the March 2 deadline. Updates regarding the 300A reporting requirements can be found here.

Arnold Torres: Latinos Not Respected By Latino Legislators

All Latinos Do Not Think Alike

The politics of the Hispanic farm employees in California is interesting. Many think there is a gulf between farmers and their Hispanic employees. Not so, said Arnold Torres, a journalist, consultant, and partner in the Sacramento-based public policy consulting firm Torres and Torres.

“I do not think there is a gulf between the farm employee in the valley and the owners of the farms. But I do think there is a big gulf between the Hispanic worker employees and the state legislature,” Torres said.

“You would think in the mind of the Latino Legislator, they believe that they are everything that these foreign workers need. That’s the fallacy because the Latino urban member of the legislature deals with the farm worker as a stereotype,” Torres explained. “They don’t sit there and have a conversation with them, and when they do, if any farm worker does not satisfy the image of a Cesar Chavez farm worker profile, then that worker is a sellout. That worker is on the grower side.”

This is all part of the fallacy of Latino solidarity.

“That’s where I have to agree with the attitude and the disposition of certain Latinos in the valley. However, the problem is what other Latinos in the Central Valley are doing to consistently challenge that disconnect,” Torres said.

“Every Latino is not monolithic. We don’t all think alike. So how does the grower and the farm worker community properly, effectively portray themselves to a population of elected representatives who happen to be Latino or happen to be white liberal or African American liberal or Asian liberal and say: ‘Ladies and gentlemen, we are not supporters of the union argument just because we’re farm workers?’ ” Torres said.

Strawberry Labor Issues May be Helped

New Technology in the Strawberry Industry Addresses Labor Issues

Once again, technology has taken crop production to the next level. This time, strawberry growers are reaping the benefits of technological advancements. Pete Molero and his team at Plantel Nurseries have come up with a transplanting machine that will address labor challenges in the strawberry field.

“We have come up with a transplanting machine that uses a 25-man crew to plant strawberries that have foliage on them and have a plug just like a transplant vegetable plug now,” Molero explained.

He further added that the machine can plant an acre an hour, a pace that would typically take 80 to 100 employees to achieve.

According to Molero, the process is simple.“The plug goes in, the plant gets dirt, and its set and ready to go.”

He described the root itself as a two-and-a-half to three-inch plug with first growth leaves at about three to four inches tall. As of right now, there is only one variety of strawberry available for the summer. However, new ones are being tested in hopes that this new equipment will continue to make improvements.

The California Fresh Fruit Association (CFFA) recently announced their Top Issues for 2019. Members were surveyed in December 2018 and ranked the top issues for CFFA to concentrate on in 2019.

Mechanically Harvesting Broccoli

Saving Labor Cost in Broccoli Harvest

Josh Ruiz and Monsanto Seeds have partnered up to harvest broccoli mechanically. Ruiz is vice president of AG operations with Church Brothers Farms in Salinas.

“They brought us a genetic variety of broccoli where the head does sit up higher. When it comes to broccoli, all varieties have their heads mature at different rates,” Ruiz explained.

That being said, the fields must be harvested multiple times as the crop matures. With these new genetics, you can get it all done in one sweep.

“I want it to be as simple for my people because I want them to be happy. Cutting once and moving on is what makes them happy,” Ruiz said.

There are a bunch of growers around California, Arizona and in Mexico; they want to get that ground back and use it one more time before the season’s over.

“This gives them about a month’s worth of time back in their hands, which, in the world we live in, is huge,” Ruiz said.

Ruiz said he is going to continue to develop mechanical harvesting for other crops.

“Iceberg and Romaine are the next two big projects,” he explained.

Iceberg is known to be the “holy grail.” Ruiz has a prototype in the works, and he’s willing to work with anyone who is willing to partner.

“The Broccoli Project, the last five years, has overwhelmed my team and me, but we are ready for the next challenge,” he said

“My day to day is focused on not only running the AG operations for Church Brothers, but I spend a lot of my day focused on innovation and how can we do things better, quicker, faster, cheaper,” he continued.

Ruiz is passionate about automation and innovation. He is currently working with lettuce, romaine, broccoli, cauliflower, spring mix, spinach, and kale.

He said his interest in mechanical harvesting is mostly based out of labor issues, but it goes further from there.

“I see this as the future. I’m not the computer guy, and I’m not the engineer, but I love that stuff, and I want to go find out how to make it possible for me to learn,” he said.

Approximately five years ago, Ruiz began his relations with Monsanto with the Broccoli Project.

“We just unveiled our brand new version of our machine, and I have no doubt in my mind that it’s going to be out there in the field. You’ll see it going down the Salinas Valley from here on out.”
