It’s Time to Manage Your Water Assets

It’s time for growers to start preparing for the implementation of the Sustainable Groundwater Management Act, otherwise known as SGMA, and groundwater consultant Chris Johnson is here to help.

Johnson, owner of Aegis Groundwater Consulting based out of Fresno, stressed the significance of farmers instrumenting their wells.

“It’s good for them to be able to manage them as assets, and then the data is important to defend themselves if they find they are being lumped in through SGMA and not being effectively represented,” he said.

Being misrepresented under SGMA can be a result of an “index well” data measurement. Index wells are a method of measuring water table levels in the area. However, their location might differ from where a farmer’s well is—meaning the data may not be indicative of the water the farmer is actually using.

Some growers might be concerned that metering their well may put them at risk of exceeding a pre-established limit, but according to Johnson, the meters provide enough data to prevent this from happening.

“The flow rate from the well not only tells you how it is behaving, but it also gives you another number to evaluate what the distribution and application systems are doing, so it’s a check that is available for them as well,” he said.

An important blueprint for the success of farming in the Central Valley is being developed to present to California government officials. This blueprint outlines what must be done to get water to the eight counties south of the delta. The blueprint is a critical step to help keep farmers in business due to the pressure from the Sustainable Groundwater Management Act.

“I remember this isn’t just about farmers. This entire Central Valley depends on a functioning water system. Whether you are a farm owner, a farm worker, a city councilman or somebody who works at a milk plant or at a library, it doesn’t matter,” he said. “San Joaquin Valley is in this together, and it is an all or nothing situation. This is being labeled as a farmer-led effort, and it is misleading.”

“This is a very broad coalition of very unusual interests coming together to promote this,” Amaral said.

As Californians endured the drought, they did an excellent job conserving water—maybe too good.  As the article below from Families Protecting The Valley explains, all the low flow toilets, all the 1-minute showers meant less water pushing waste through the sewers.  All that “resulted in corroded wastewater pipes and damaged equipment, and left sewage stagnating and neighborhoods stinking. Less wastewater, and thus more concentrated waste, also means higher costs to treat the sewage and less recycled water for such things as irrigating parks, replenishing groundwater or discharging treated flows to rivers to keep them vibrant for fish and wildlife.”

So now some water agencies are pushing for more outdoor conservation efforts rather than indoor to keep the wastewater flowing.  Adam Link, director of operations with the California Association of Sanitation Agencies asks the key question:  “At what point are you causing more harm than the benefit you are getting from saving those drops of water?”

Another major point we would point out is with the reduced VOLUME of water flows, it has created higher concentrations of pollutants per each gallon of water that gets discharged into the Bay-Delta. With low flow toilets’ rates at 1/2 or lower previous volumes and appliances using less water, all the pollutants that impact fish and people are at double or more on a per-gallon basis getting dumped into the Bay-Delta. Some permit to dump 180 million gallons of sewage water into the Bay-Delta, but the pollutant concentration is double or more.  This makes the pollution from sewage plants going to the delta that much more troubling.

Remember, in 2010, water authorities determined the Sacramento Regional Wastewater Treatment Plant “was discharging too many pollutants into the Sacramento River, threatening public health and harming aquatic life in the Sacrament-San Joaquin Delta.”  The water board found that high volumes of ammonia in the water were disrupting the food chain and endangering fish such as salmon and Delta smelt. Single-celled organisms posed health risks to people who came in contact with the river water.

Wastewater authorities were given until 2021 to remove the ammonia, giardia, and cryptosporidium which endanger fish and humans.  In the meantime, the pollutants keep coming and the policy of cutting off water for farmers is still the favored solution.

This is why farmers are so frustrated.  They see the wastewater situation as the real threat to endangered fish, but water the bureaucrats sole solution to Delta health problems is withholding water from farmers.

Proposed Legislation (SB1) Threatens Voluntary Agreements on Wate

Statement by Mike Wade, California Farm Water Coalition Executive Director:

SACRAMENTO, CA – Prior to last December’s State Water Board meeting, both Governor Brown and Governor Newsom took the bold step of supporting a completely new approach to water policy. With their encouragement as well as hard work on the part of scientists, farmers, environmentalists, and other stakeholders as well as the California Environmental Protection Agency and the California Natural Resources Agency, Voluntary Agreements are nearly complete. However, all the progress will be lost if SB1 goes into effect.

As written, SB1 locks California into our failed regulatory system that has not worked for anyone and has guaranteed nothing but lawsuits and delays.

And while the legislation gives lip service to supporting the VA process, make no mistake about it—SB1 would result in the colapse of the Newsom Administration’s voluntary approach to updating California water policy.

It’s hard to overstate the break-through represented by the VAs. A completely new approach to managing water, they require scientific studies and put the new science into practice. They provide an agreed-upon amount of water for river flows as well as new environmental projects and other improvements—paid for by farmers, water districts, and other users—that will help get maximum benefit from the water.

In addition, all water users will have more certainty of water flow that is simply not a part of our current system. And probably most important, because the VAs are the product of compromise and agreement on the part of all water users, we can move forward today, removing ourselves from the endless cycle of lawsuits that has dominated California water policy. Real results will be felt now, not 10 years from now.

We hope the Legislature can find a way to join the Governor in charting a new path to smarter water policy.

Valley Water Management Ordered To Improve Facility

Valley Water Management May Be Putting Groundwater at Risk

The Central Valley Water Regional Quality Control Board has issued a Cease and Desist Order requiring Valley Water Management Co. (VWMC), an oil field wastewater disposal center, to either bring its McKittrick 1 and 1-3 Facility into compliance with water quality regulations or stop discharging wastewater at the facility.

“Valley Water provides a valuable service to the oil industry in Kern County, but discharges from the McKittrick facility must not put groundwater beneficial uses at risk,” said Patrick Pulupa, Executive Officer of the Central Valley Water Board.  “With this Cease and Desist Order (CDO), the Board has said that if this facility cannot be brought into compliance with current regulations, discharges at the facility must cease.”

In California, water and oil are co-mingled in underground oil-bearing geologic formations, and both oil and water are brought to the surface during production. That water is called “produced water,” which is known to have naturally occurring contaminants like salinity, chloride, and boron that make the water unsuitable for human consumption or to irrigate agricultural crops.

VWMC disposes of poor-quality produced water from the South Belridge, Cymric, and McKittrick oil fields at the Facility. The Facility has 163 acres of unlined disposal ponds where, according to the company’s recent reporting, 2.8 million gallons of produced water are discharged each day.

In issuing the CDO, the Board found that the cumulative effect of disposing produced water at the facility over many decades has created a highly saline wastewater plume that is migrating to the northeast, where it threatens higher-quality groundwater designated as supporting municipal and agricultural uses.

The CDO requires VWMC to complete a full characterization of the nature and extent of wastewater impacts, an important step toward protecting the beneficial uses of groundwater. If VWMC cannot demonstrate that its discharges at the facility are not causing pollution, the CDO requires VWMC to either upgrade the facility or cease discharging produced water.

Delta Smelt Are Poor Swimmers, Unlikely to Reach Pumps

How Many Smelt Are Actually At the Pumps?

Delta smelt are poor swimmers. When they have to swim against voluminous outflows, they struggle. They also lack endurance for distance and swimming against currents. This was the result of the taxpayer-funded swim performance test conducted more than 20 years ago. Why is this important?

Delta smelt live in the freshwater/saltwater mixing zone made up of outflow from the fresh waters of the Sacramento and San Joaquin Rivers, and the inflow of saltwater pushed towards that freshwater from the ocean tides. Smelt leave this mixing zone in search of freshwater to spawn, in the late winter to early spring. It is the same time of year when the outflows from the Sacramento and San Joaquin Rivers are at their peak. Recently, water surging out from the rivers was equal to 104,900 basketballs per second!

If the smelt are able to swim against these powerful outflows, they don’t go too far, and generally spawn pretty close to the nearest region of freshwater they can find in the delta. However, most smelt being surveyed during spawning are not in the delta at all, rather, in the much smaller waterways to the north where there is a fraction of the freshwater outflow. Twenty-one years ago, UC Davis acknowledged outflows from the Sacramento and San Joaquin rivers are actually too high for the endangered smelt!

Let’s jump to the “pumps.” They are about 60 miles away from where smelt live in the mixing zone of the Suisun and San Pablo Bays. The pumps capture water at the south end of the delta, where it later flows into storage at San Luis Reservoir. Eventually, it is conveyed south to 2/3 of the state.

Water that is not captured by pumping surges out from the Sacramento and San Joaquin Rivers into that mixing zone. These pumps are routinely throttled back because, according to the Smelt Biological Opinion, smelt are in danger of getting sucked-in and killed. The result of not pumping is huge losses of water for human use and huge increases of outflow from these two rivers into the ocean.

So how many smelt, who lack endurance for long swims according to the swim performance test, are actually surveyed near the pumps and at risk of being liquidated? Every month, a trawl survey is conducted to count smelt and find out where they’re hanging out. I pulled up the fish distribution maps for every monthly trawl over a 10-year period. The closest a smelt has been surveyed near the pumps is about 30 miles away from them, seven years ago.

Still, in spite of their own swim performance tests, the opinion is that smelt swim about a 60 mile, squiggly endurance course, destined for the pumps. Remember, they spawn in freshwater, but actually, live back in the mixing zone where they must return. Nonetheless, this opinion is the very hypothesis that ratchets back pumping at full capacity and prevents the securing of water for humans. There are many other facets of the opinion that are questionable as well. Incidentally, just two smelt have been surveyed anywhere in the last 10 months.

Here’s the good news. President Trump signed an executive memo in October, requiring the Biological Opinions to be reviewed and updated. The science is well over a decade old. Please notice it is called an “opinion”, not a fact. Trump set a timeline and a deadline to get it done too. The assessment phase had to be completed by January 31, and it was. The deadline for the new Opinions to be issued is 135 days after the assessment, which I calculate to be around June 15th. I’m counting.

In the next couple of months, we’ll likely be hearing a whole bunch of malarkey coming from the folks favoring water for the sea in the name of fish, instead of for humans and the earth. There will be an uproar when the Biological Opinions are revised to actually help endangered fish, instead of being used as a vehicle to implement an agenda of man-made water shortages, more regulations, increased fees, and new taxes. You will hear misinformation, but you will know the truth.

Consumer Protection Is Top Priority for LGMA

New LGMA Irrigation Requirements Mean Heightened Food Safety Measures

As consumer protection continues to be a number one priority for producers, main pathogen routes are of the utmost importance for guaranteeing safety. The California Leafy Green Marketing Agency (LGMA) is a program that works to continually keep the lettuce industry safe and maintain confidence in food safety programs—but as pathogens begin to evolve, it takes a team effort to combat future threats.

Mike Villaneva, LGMA technical director, told California Ag Today, “It’s been a tough 18 months, and it’s the challenge with these outbreaks … we never really have a good answer about what happened and how it happened.”

In the leafy greens industry, water becomes a focal point in pathogen prevention. “We’ve got 12 years of testing water, and we’re pretty confident of water in the deep wells along the Central Coast, but down south is a different ballgame—that’s open surface water,” Villaneva said.

On April 19th, the LGMA board met and voted to strengthen mandatory food safety practices required on farms. One facet included prohibiting overhead irrigation 21 days prior to harvest unless the water is sanitized.

“They’re looking at some other potential testing and data that could lower that down to 14, but right now they’re sticking with the 21 overhead,” Villaneva said.

Wastewater Treatment Plant in Delta Causing Problems

Harmful Algal Blooms Impacting Watershed

The San Francisco Bay Regional Water Quality Control Board updated its regulations on nutrient discharges into the San Francisco Bay watershed recently to protect the watershed from harmful effects of discharges from municipal wastewater treatment plants and other sources.

Although San Francisco Bay is not impaired by nutrients, it is a nutrient-enriched estuary with higher nitrogen and phosphorus concentrations than most estuaries in the world. Too much nitrogen and phosphorous can lead to harmful algal blooms, which can release toxins to the Bay. Harmful algal blooms can also result in low dissolved oxygen or insufficient oxygen in the water to support aquatic life.

In the Bay, nitrogen has the biggest influence on phytoplankton growth, and the Region’s municipal wastewater treatment plants account for 65 percent of the nitrogen discharged to the Bay. Regional population growth will increase these nitrogen discharges.

The regulatory update, in the form of a reissue of the Nutrients Watershed Permit first adopted in 2014, provides a consistent approach for regulating nutrient discharges from municipal wastewater treatment plants in the San Francisco Bay watershed.

The first Nutrients Watershed Permit required sewage treatment agencies to: (1) monitor their discharges, (2) support scientific studies to evaluate the Bay’s response to current and future nutrient loads, and (3) evaluate opportunities to remove nitrogen through treatment plant improvements.
This update will increase monitoring and scientific studies. Importantly, it requires treatment agencies to evaluate opportunities to remove nitrogen using “green” solutions, like routing wastewater through treatment wetlands and wastewater recycling.

These types of opportunities may provide water quality benefits beyond nutrient removal, for example, by providing protection against climate change through carbon sequestration and adaptation of the shoreline to address sea-level rise. Green solutions can also remove additional contaminants of emerging concern for water quality.

65% Percent Water Allocation for Westlands with 163 Percent Snow Pack

Statement on Bureau of Reclamation’s April Water Allocation Announcement

Today, the Bureau of Reclamation announced the water allocation for south-of-Delta Central Valley Project agricultural water service contractors is being increased to 65%. In light of current hydrologic and reservoir conditions, this minor increase is astonishing.

Thomas Birmingham, Westlands Water District’s general manager, stated: “This announcement begs the question, what has to happen before south-of-Delta farmers served by the Central Valley Project can get a full supply?”

With San Luis Reservoir full and flood flows coming, the 65 % allocation was more than disappointment.

Since October 1, the beginning of the current water year, California has been blessed with abundant precipitation; the 2018-19 water year is now classified as wet. As of April 8, the snow water content in the northern and central Sierra Nevada was 160% and 163% of the long-term average, respectively. Storage in every CVP reservoir used to supply south-of-Delta CVP agricultural water service contractors was more than 100% of average for that date. Indeed, these reservoirs were and remain in flood control operations.

Birmingham added, “I know that Reclamation staff understands the consequences of the decisions they make. Reclamation staff understands reduced allocations in a year like this needlessly increases overdraft in already overdrafted groundwater basins. Reclamation staff understands delayed allocation announcements make it nearly impossible for farmers to effectively plan their operations. If Reclamation’s leadership could, they would make a 100% allocation. But Reclamation’s hands are tied by restrictions imposed by biological opinions issued under the Endangered Species Act. These restrictions have crippled the CVP and have provided no demonstrative protection for listed fish species, all of which have continued to decline despite the draconian effect the biological opinions have had on water supply for people.”

Birmingham concluded, “Notwithstanding the restrictions imposed by the biological opinions, Westlands firmly believes that there is sufficient water to allocate to south-of-Delta agricultural water services contractors 100%. Today’s announcement by Reclamation is disappointing for every south-of Delta farmer served by the CVP, and we hope Reclamation will increase the allocation quickly to enable farmers to quit pumping groundwater.”

After 2019, no one will be able to argue that water supply reductions for south-of-Delta CVP agricultural water service contractors are a result of hydrologic conditions. This year demonstrates only too well the crippling consequences of ineffective and unchecked regulations. Because of restrictions imposed on operations of the CVP under the guise of protecting fish, the CVP cannot be operated to satisfy one of the primary purposes for which it was built, supplying water to farmers.

Dire Need for Temperance Flat

Temperance Flat Dam Could Minimize the Devastation of SGMA

Mario Santoyo, Executive Director at San Joaquin Valley Water Infrastructure Authority, explained the dire need to build Temperance Flat Dam to California Ag Today recently, and the possible consequences if it is not built.

“With the new groundwater sustainability law coming into play, it is going to basically shut down a lot of farming,” he said.

If farmers cannot prove that they are replenishing the amount of groundwater as they are taking out, they are not going to be allowed to use the groundwater pumps.

“With the continuing extraction of our surface water by the environmental community and by governmental regulations, farming in the Central Valley is in for a world of hurts,” Santoyo said.

The Temperance Flat Dam would give the ability to manage the high run-off water that is otherwise lost into the ocean.

“We are losing millions and millions of acre-feet into the ocean that makes absolutely no sense to anyone,” Santoyo explained.

Temperance Flat would provide additional storage opportunities—up to an additional 1.2 million acre-feet—and will allow farmers to have carryover water from year to year. This will carry the farmers through the dry years, and it will give the allowance to stabilize the groundwater condition.

This dam needs funding from federal, state, and local water agencies.

“The JPA that we represent secured 171 million dollars, which is enough money to pay for the environmental paperwork and initiate the engineering,” Santoyo said.

The remainder of the funds has come in chunks from the federal government through the WIIN Act.

“The bulk of it will have to be the end users, the beneficiaries, i.e. the water agencies,” Santoyo said.

Right now, they are working on the process to evaluate the level of investment that they want to partake in.

“The way this project will work is multidimensional. But the key element will be storage management,” Santoyo said.

The investors would be buying chunks of storage cells in that reservoir to manage.

“In some cases, if you have a bad year in which you have water and others don’t, you’d be able to work something out with them,” Santoyo explained.

“Temperance Flat was a part of the focus when the WIN Act was being put together by Senator Feinstein and Congressman McCarthy,” Santoyo said.

The money allocated is enough to keep the project moving forward on an annual basis.

President Trump signed a memorandum a few months ago, however, Santoyo said, “Since I’ve been involved for a longer period of time, unfortunately, that memorandum that was signed in effect really didn’t do anything.”

Federal courts had already ruled previously that the biological opinions needed to be redone.

“All this memorandum did was just accelerate the study of it,” Santoyo explained.

A resolution on the Delta does not look like it will be here anytime soon.

“That’s why I think that if you have an opportunity to do something positive that doesn’t affect usage of the Delta water you should take it,” Santoyo said.

That’s what Temperance Flat does.

“Three billion dollars represents the full construction of the dam,” Santoyo said.This is the targeted budget for the dam. If the funds can be collected and in time, the dam will be fully operational by 2033.
