Agriculture Is Primed to Provide Different Food to Masses

Lowell Catlett says California agriculture is in a good place.

Lowell Catlett, a former professor at New Mexico State University who continues to lecture with a style that keeps the audience engaged, shared with us what a great time it is to be in agriculture. “I think it is the best time because we have never had a period in history where we have had so many people, worldwide, rising out of abject poverty into middle class” he explained.

“They become consumers, and they want things, and they want a lot of things. They want the things that they see other people have. That means they want California pistachios, almonds and walnuts, and all the bounty that California produces, including its milk and eggs and cheeses, and everything else,” Catlett said.

“Once someone earns more money, one of the first things they change is their diets, and they like to get things that are unusual and unique. And California is the breadbasket of the world in terms of its ability to produce different things, and you’re seeing that translate into best time ever to be in agriculture,” he said.

Not only does current agriculture have the products, but there is plenty of money to buy those products. “There is so much money. The net worth of the United States right now over 123 million households is $94 trillion. The world’s output last year was $73 trillion, so we have $20 trillion more in household net worth than the whole world combined, The consumers want organic, or they want certified to the source. We have to certify those things to the source. They want all kinds of different food choices,” Catlett said.

“Before, people just wanted food, and they now want all these other foods. They may want gluten free, and they many not even have celiac disease. And it all helps the farmers to have markets we never had before, and that is fabulous,” Catlett said.

Managing DiMare Fresh Tomatoes

Season Starting for DiMare Fresh Tomatoes

DiMare Fresh is a fresh market tomato company with operations throughout California. California Ag Today spoke recently to Brian Souza, who is the in-house pest control advisor, among other things, for the company.

Souza explained how he manages the work throughout the state: “We start down south and work our way north as the season progresses. Other than being a PCA, I start in the greenhouses and manage our transplants, and just work from there.”

“We also schedule all the plantings, and manage the crops, and myself and another PCA walk the fields two times to four times a week. We always have someone in the fields every day looking, because … fresh market is sensitive, and they definitely need a lot of attention,” he said.

“We have great team members, and communicate constantly. We’re always in different areas at different times, so if there’s something I’m missing the other guys hopefully catch it, and that’s usually the case. It’s a lot of good communication and team work,” he said.

DiMare Fresh does not grow any tomatoes, but they manage a lot of growers who grow for the company.

“DiMare doesn’t own any of the property, but we do have growers that grow for us. And they are very loyal growers that we’ve had for 20, 30, 35 years.

All the rain this winter certainly can be a game changer for companies like DiMare. “We are one of the first tomato companies to start planting,” Souza said. “We love these rains, but it does bring challenges getting in as early as we normally would like to do. Sometimes we’ll have to just chance it and get our stuff in if we can.

Rains also means a lot of weeds in those fields. “For sure, there’s a lot of weeds out there, and especially with the drought we’ve noticed some newer weeds that are taking over, that are a little more drought tolerant. Horseweed and hairy fleabane are the most prominent,” Souza said.

Post Methyl Bromide Era Creates Questions

Without Methyl Bromide, Then What?

Methyl bromide was first identified as an ozone-depleting compound in 1991 and was scheduled to be phased out by 2005. California strawberry growers found it irreplaceable and fought for exemptions that allowed the fumigant to be used through 2016.  Mark Bolda is a UC Cooperative Extension Farm Advisor who specializes in strawberries and caneberries and also serves as the County Director for Santa Cruz County.  He discussed the work being done to find an effective alternative to methyl bromide.

“It’s not just one thing does it all; it’s going to be one thing and then you add other things on top of that. … We don’t have the silver bullet anymore; it’s gone.  We need to figure it out using the systems approach,” Bolda said.

The inability to use methyl bromide is causing some concerns for strawberry growers, who are looking at what new type of management approach to take.  “Everybody’s familiar with the concept of integrated pest management for insects, and really, we need to approach this post methyl bromide era using integrated pest management,” Bolda said.

Growers are worried about how vulnerable their crops are going to be to various soil diseases without methyl bromide, as researchers have yet to find an alternative that is equally effective.  One of the ways to combat disease is to focus on the details of planting.

“In strawberries, you have different chill times. You know, if you add cold conditioning, you give the plant more vigor. The colors of the plastic that you’re using to manage the temperatures of the soil, the amount of fertilizer that your using, all of these things now, we need to start to integrate into the way we are growing the strawberries,” Bolda said.

Methyl bromide controls a variety of pests in agriculture.  It was also commonly used to treat commodities like grapes, asparagus and other imported goods to prevent introducing pests to the U.S.  Bolda expressed disappointment in the lack of preparation in finding an adequate replacement for methyl bromide. “Here we are, zero hour, and we don’t have this worked out. I think, to some extent, there’s been a lack of leadership in the industry,” Bolda said.

The quest for replacing the fumigant might have gotten a late start, but industry experts have been working double-time to find solutions. “We have got all of the researchers in this industry together, working as a unit, and there’s a lot of smart people working on this problem right now. …. What do we need to research? What do we know? What do we not know? Let’s go,” Bolda said.

Nearly 90 percent of methyl bromide use in California was for pre-plant soil fumigation in strawberries, nursery crops, grapes, and tree fruits and nuts.  Growers are preparing for a 5 to 10 percent drop in yield as a result of methyl bromide’s absence and are looking for ways to make up that deficit.

“Maybe using more precise fertility practices, adding cold conditioning to the plant, taking it away, using different varieties.  All of this is going to start to go into this system,” Bolda said

The phasing out of methyl bromide is most impacting to the strawberry industry, which is California’s third most valuable crop behind almonds and grapes, with annual farmgate sales of $2.5 billion dollars.  The biggest disease threats to strawberry fields are macrophomina phaseolina and fusarium, which can both have devastating results in crops.  “It’s plant collapse. You’ll see it kick in once the plant loads up in fruit and gets a little warm. It’s just too much stress for the plant,” Bolda explained.

Methyl bromide will be missed by growers, but its absence is allowing them to demonstrate their creativity in finding new solutions to a problem. “We’re starting to see some methods that are pretty interesting,” Bolda said. One such method is steam, which involves pushing steam into the soil to kill certain pathogens.

Breeding in resistance to disease can also be beneficial; however, it can have some negative consequences as well.  “When you have strong tolerance, you’re taking a hit on something else. There’s no such thing as a free lunch. You might have a plant that’s super resistant but then the yields are low, it doesn’t fruit until late. There’s always the trade off,” Bolda said.

Getting a good chill before planting can also be effective in making the plant more vigorous and better able to withstand disease pressure.  “It’s a little complicated because the longer you chill, the later you’re planting times get, and if you’re planting in the middle of December, [there’s] not a light of sunlight in the middle of December, so you know, there’s a trade off there too,” Bolda said.

Crop rotation can also assist with some soil diseases, but more research is needed to determine just how effective it is.

Methyl iodide was showing some success as a possible replacement for methyl bromide, but its use became a problematic issue.  “It became a political problem. I don’t think the industry stood it’s ground on it, and the industry, basically they struck their flags and left the field. Of course, the entire problem was defined by the opposition,” Bolda said.

Growers might have some difficulty working out a new pest management program without the use of methyl bromide, but Bolda explained that understanding the problem at hand is an excellent step in the right direction.   “Don’t just turn scientists loose and just say, ‘study and do experiments.’ No. Define the problem. I think what we’ve done with the fumigants over this last two years. Getting everybody together and working as a unit, we have defined the problem and now that mental energy and that mental potential is moving. You need to define it in order to bring the people in to solve it,” Bolda said.

It’s going to take some time to work out a program that best replaces methyl bromide, but Bolda is optimistic about the future.  “Sometimes the solutions aren’t so obvious, but they’re starting to show up and you know, the thing is that some of these will be radically different,” Bolda said.

Grafting Rootstocks on Tomatoes, A Growing Trend

Grafting Can Yield Bigger, Better Tomatoes

Brenna Aegerter is a San Joaquin County Cooperative Extension Farm Advisor. She specializes in vegetable crops, and she’s working on tomato plant grafting for market tomatoes. “Right, they would be doing it at the greenhouse. They’d start off the plants like normal, except they’re planting both the rootstock and the regular fruiting variety, so you’re planting two seeds. Then, these little seedlings are cut in half and put back together with the root stock on the bottom” Aegerter said.

The tomatoes are then placed in a dark, humid chamber, which allows them to heal for about one week. Following this step, the plants are then moved back into the greenhouse. This process speeds up the growth cycle on these plants by about two weeks. When the tomatoes are ready to ship, they look the same as any tomato plant except; these have a plastic clip that helps support the graft union. “It’s really soft, like a biodegradable silicon,” Aegerter said.

There are a few reasons why this process is necessary. “We want to increase the vigor of the plants, and we want more fruit, more vine, and bigger fruit. This is for fresh market tomatoes,” Aegerter explained.

It is not necessary on processing tomatoes, as the grower wants total tonnage. “We’re looking for some resistance to some of these diseases that we have. The idea being that maybe we can reduce,” Adgerter said.

One way to avoid the soil borne diseases is to plant tomatoes with the grafting union above the soil. These tomatoes however, have a tall transplant and most of the stem is buried. There’s no way in current production practices to plant with the union above ground. “But even with the deep roots, the rootstock is vigorous,” Aegerter said.

This rootstock must be bred. Sometimes they are a wild species, but for the most part, they are hybrids of wild and cultivated tomatoes. They contain some characteristics of a wild tomato but have a tomato rootstock breeder. The breeder, Monsanto/Seminis, is working worldwide for different markets. “[Their] job is breeding rootstocks,” Aegerter said.

This practice is an emerging standard that is becoming more common in other parts of the country. This takes place in the Southeast such as North Carolina. They are growing stake tomatoes, which is a very different production system. They pick multiple times while growers in California pick once.

The greenhouses aren’t set up with automated grafting. All of the grafting is done by hand. “To bring that cost down to a price that we’d like to see, they’re going to have to be more automated. But how can they justify the decision to invest in very expensive automated grafting equipment, if they don’t know if the market is there?” she said.

Turkeys come from several areas of the state, and while California is ranked No. 7 in turkey production, we do supply most of the western United States.

The famous Mrs. Cubbison’s dressing comes from Sophie Cubbison, a California entrepreneur who was born in 1890 in the San Marcos area of San Diego County. A longer fascinating story made short: In May 1920, she graduated from California Polytechnical University with a degree in Home Economics. In 1948, she added seasoning to broken pieces of the popular Melba toast to make stuffing. A factory in Commerce, California churns it out this time of year.

Farmers and farmworkers in California produce almonds, raisins, walnuts, prunes, pistachios, figs and dates, apricots, pumpkins, pecans and pomegranates. . . right on up the food line.

These are all part of the American Thanksgiving feast.

Celery from the Oxnard and Ventura area, and the rest of the ingredients for the stuffing mix, plus carrots, lots of crisp lettuce and fresh spinach from Salinas — all these greens waiting for you, already washed and bagged in the produce department. The green beans in your casserole come from California growers.

You’ve got oranges and kiwi fruit, table grapes, strawberries, raspberries freshly harvested from the Salinas and the San Joaquin Valleys. You’ve got sweet potatoes from Merced County — this is their pinnacle season. You’ve got all kinds, colors and sizes of potatoes and tomatoes, plus parsley, onions and garlic. . .  all grown in California.

Practically all the fruits, vegetables and nuts make America’s Thanksgiving celebrations festive, and nearly all of them come from California.

And don’t forget about the great variety of California winegrapes cultivated by California growers and then crafted with great care into great California vintage.

Wait! We grow firm, juicy apples and those small round watermelons that are a great snack or accent to a flavorful dessert fruit salad. And besides poultry, we even have California lamb, beef, rice or pasta—if you want to go that way.

Of course, you’ve got Martinelli’s sparkling apple or grape cider from Watsonville, near the Monterey Bay area. Local growers provide the tree-ripened fruit to the award-winning company, which is still family-owned and is run by the founder’s grandson and great-grandson.

At more than 140 years old, Martinelli’s is merely one century younger than our nation. In fact, the company received a first place award at the California State Fair in 1890.

By the way, do you know that little pop-up turkey timer that indicates when the turkey has reached the correct internal temperature? Food public relations genius Leo Pearlstein¹, along with a turkey producer from Turlock, invented that gizmo. Pearlstein, who handled the promotions for the California Turkey Advisory Board, was contemplating the enduring Thanksgiving conundrum—how long to cook the turkey and how to figure out when it is done?

Pearlstein said he and the turkey rancher were sitting in Pearlstein’s test kitchen mulling over ways consumers could determine when the turkey was done. They noticed the fire sprinkler system overhead. When the kitchen gets too hot, the fire sprinkler turns on. A metal alloy in the sprinkler is activated or melted when subjected to the high temperature of a fire in the room (185 degrees Fahrenheit). They applied that concept to the pop-up timer.

Officially, the National Turkey Federation advises consumers also use a conventional meat thermometer to verify that the cooked turkey’s internal temperature reaches:

165 degrees F to 170 degrees F in the breast or
175 degrees F to 180 degrees F in the thigh and
165 degrees F in the center of the stuffing
.

Except for cranberries, it is really a California Thanksgiving.

Happy Pumpkin Day!

Celebrate Pumpkin Artistry!

Russ Leno, master sculptor of sand, snow, ice, wood, watermelon, and his favorite—pumpkins, appreciates the the challenge of creating carvings from hundred-pound fleshy orange masses.  “This giant cultivar of a squash plant is a good material to carve in, Leno explained. “It gives you fast results, in under a five-hour time period. I like to entertain in front of crowds, and it just gives you something that people can see.”

“Everybody likes pumpkin carving. Everybody likes a jack-o-lantern. It’s just something that everybody enjoys, from the ages of 2 to 92, or even older. It’s still one of the last things I think we do. If you don’t do any art at all, you might still carve a pumpkin at this time of year. I just like the medium, and I just like doing it. It’s just fun. It’s a lot of fun.”

A recent performer at the Big Fresno Fair, Leno’s inspiration comes from within, as well as from looking at different artist sculptures, paintings, or drawings, or different elements in nature. “I might take a culmination of two or three different things and put my own spin on them. I might like something I see, but discover a better way to put a spin on it for a pumpkin. A lot of times, a pumpkin is only going to give you what it is going to give you because it’s only so thick and it’s hollow on the inside. You’ve got to be careful.”

“Everybody seems to think that they just pulled it out of a hat, and that’s just not true. After doing this for a number of years, I realized all the great sculptors from way back when didn’t just get a hammer and chisel and start pounding rock. They did a lot of planning and drawings up front.”

Leno initiates his ginger-hued creations from drawings and photos of posed people and things. “As you learn more about sculpting, to do something good, it is a planned event.”

He acknowledged you can carve certain things in certain pumpkins that you just can’t in other ones. “I might start out saying I’m going to carve this, but find the pumpkin is not thick enough or deep enough. The sculpture becomes something totally other than what I started out with, but that’s okay. They all come out nice at the end, and it’s fun.”

Leno, who has seen a range of pumpkins, which are native to North America, from different regions in the country with variations in size, shape, color and texture, but he prefers Prizewinner Pumpkins and small Atlantic Giant Pumpkins from the central California coastline. “These 100-pounders or 150-pounders are really good carvers because of the thickness -to-size ratio is very well proportioned so that you can get a fairly deep cut along with a proportionate-sized piece. They’re just great carving pumpkins.”

“I carve large pumpkins, and the people who grow the large pumpkins and I share a great love for the pumpkin itself and what it takes to grow them to their large sizes and their capability of being sculpted. You just don’t find these giant pumpkins just any old place. They require a little better soil conditions and fertilizers and specific pH balance in the soil to get these up at these sizes.”

“Pumpkin carving, which began as an all-American craft, has gained international popularity because of the internet and cultivation of pumpkins in other countries. A lot of countries now celebrate Halloween like we do, and people across the globe are now carving pumpkins and having a good time with them.”

“The internet has also created a way for sculptors to share their different carvings with like-minded people around the world.”

California Growers Confront Labor Issues

Labor Issues—Costs and Farmworker Shortages—Challenge Growers

This year, farmers grappled with labor issues such as shortages and increased labor costs. Some growers had more than enough workers available, while others experienced difficulty in meeting their labor needs. Dave Phippen, co-owner of Travaille & Phippen Inc., a vertically integrated company that grows, packs and ships their own almonds, described some of their struggles with labor this year. “We employ a little more than 50 people year-round, but for harvest we ramp up an extra 15-20 people. There was a squeeze on the availability of the labor and a challenge with what we thought was an acceptable rate of pay,” said Phippen.

almond assessment increaseAs minimum wage increases incrementally every year, growers will struggle to keep up with the higher wages. “There was a new reality in the typical forklift driver, people working in receiving, people sampling,” Phippen elaborated. “We’re paying a little bit more for all of those tasks this year, and because there were more employment [opportunities], it was harder to find people who were available and willing to work.” Phippen also noted that employees “were requiring a greater compensation rate than last year for the same job.”

Travaille & Phippen’s operation has had to reevaluate employee compensation. Phippen explained the principle that as minimum wage increases, compensation rates compress, such that a person who was earning $15 used to be $5 above minimum wage, but is now is only $4 above minimum wage,” Phippen said.

The current federal minimum wage, established in 2009, is $7.25 per hour, up from $5.85 just two years prior. Of the top 10 agricultural producing states in the country, only 4 have minimum wage rates higher than the federal level. California and Massachusetts have the highest minimum wage levels of any other states.

Travaille & Phippen was already compensating a great deal of their labor force above minimum wage; however, to stay competitive and retain their workers, they increased their compensation rates, which caused a ripple effect throughout the supply chain. As their labor costs increased, they had to charge growers more for processing. “It had a big impact on them,” said Phippen, “particularly because those growers are receiving less revenue for their crop this year than they did last year. It was quite a squeeze for our growers and we were caught in the middle of that squeeze,” Phippen explained.

almond-tree-shaking-harvestingLabor issues have also been a significant concern for Mark Van Klaveren, a diversified farmer in Madera who grows almonds, watermelons and Thompson seedless grapes. Van Klaveren noted that timing plays a big role in their labor situation. “Since we tend to pick our Thompson seedless late, when there is a lot of sugar, we were able to get plenty of labor because most of the other vineyards were finished. Their farmworkers were looking for someplace to work.”

Van Klaveren reported that labor proved more challenging for their other crops. “I have a steady crew for watermelons, although with the new laws coming into effect, we are going to have to make some changes and mechanize a lot more of that harvest,” Van Klaveren noted.

Labor costs will become further complicated in the years ahead as overtime limitations established in AB 1066 phase in, beginning in 2019, with all agricultural operations expected to be in compliance by 2025. The combination of increased wages and the limitation of hours will change the way many farms operate. Some growers will increase mechanization. Others growers of labor-intensive crops may replace their crops with commodities that require fewer hours to harvest.

Van Klavern noted, “The only options we have are to mechanize or get out—one of the two. We can’t afford to produce at the same prices we’re getting right now with much higher labor costs. Some machinery out there can do what we need to do and we will look real hard to get some of that in our operation,” said Van Klavern.

An economic analysis conducted by the Highland Economics firm, shows AB 1066 having significant consequences for California agriculture. The study found the policy would reduce farm production as well as farmworker income, and the new time constraints on farmworkers would negatively impact California’s overall economy.

Van Klaveren is skeptical the new legislation will create any positive outcomes. “Workers want to put in the hours. They want to work. If we’ve got to pay them higher wages to start with, and then overtime on top of that after eight hours? There are certain jobs that won’t sustain the higher wages,” Van Klavern said.

In addition to increased costs for employers, increased minimum wage negatively affects workers who are trying to get their foot in the door of a farming operation. When the government raises the entry-level wage so high that people really have to produce a lot per hour, Van Klavern clarified, inexperienced applicants will suffer. “If you cannot produce a volume of work that is worth $15 an hour or more, you cannot work because nobody is going to hire you to lose money,” noted Van Klaveren.

Collectively, farmers are looking at overall labor cost increases between 5 and 15% over the next few years, depending on the crop. Van Klavern expressed a widely-held view that continued government intervention, particularly in the area of wages, is making farming in California unnecessarily difficult. “The whole issue of employment is a private agreement between an employee and employer, as in, ‘I will work for you for so much an hour and try to produce to your expectations.’ In other words, if somebody is willing to work for $8 an hour, why not let them work for $8 an hour? If it is fine with them and fine with the employer, then why not?” said Van Klavern.

The costs of labor and limitations on farmworker hours, combined with the costs of water and increasing environmental regulations, may prove insurmountable for California agriculture. “The economics is all simple, but the government steps in and complicates everything. I guess that leaves it to us to have to figure out how to swerve between all the regulations and stay in business,” noted Van Klavern.

Eighteen New California Farm Academy Graduates!

Eighteen New Farmers Graduate from California Farm Academy

The California Farm Academy, a part-time, seven-month, beginning farmer training program run by the Land-Based Learning, graduated 18 new farmers on Sunday, September 18, 2016.

 

With more than 250 hours of classroom and field training behind them, these enterprising graduates were honored by notables such as Karen Ross, secretary, California Department of Food and Agriculture (CDFA); Craig McNamara, president and owner of Sierra Orchards, as well as president of the California State Board of Food and Agriculture; Sri Sethuratnam, director, California Farm Academy (CFA); and Mary Kimball, executive director, Center for Land-Based Learning, based in Winters California.

“The impetus of our program,” said Christine McMorrow, director of development for Land-Based Learning, “is the need for more farmers as the current ones age out. According to the USDA, over 700,000 new farmers will be needed in the next 20 years to replace those who retire.

 

CFA teachers, farmers, academic faculty and staff, and agricultural, natural resource and business professionals, teach CFA students basic production agricultural practices; crop planning; soil science; pest management; organic agriculture; irrigation and water management; marketing; ecology and conservation; obtaining loans, insurance and permits; farm financials; human resource management; risk management; farm safety; regulatory compliance and problem-solving.

 

McMorrow stated, “These folks have been with us since February, following a rigorous application process. A lot of these folks either have land they have dreamed of farming but did not know how to put it into production. Some of them come from farming families, but they wanted to get involved in the family business on their own. They may have been in a different career and now want to do something new or different. Perhaps they haven’t studied agriculture or they have not seen much agriculture other than what their family does, so this is an opportunity for them to learn and to explore a new business idea.

 

“We only take people who are serious about production agriculture. This is not a program for somebody who thinks, ‘I’ve got an acre in my backyard and I really want to grow something.’ While that’s a cool thing to do, the academy is not for those people.”

 

“Our graduating farmers, who range in age from their late 20s to early 50s, each wrote a business plan and presented it to folks within the agriculture industry,” said McMorrow. “They also planted some of their own crops on a farm in Winters.

 

McMorrow elaborated, “These new farmers have been able to create their own networks, having made contact with more than 40 different folks within the agricultural industry throughout the time they spent with us. These networks include local farmers around Yolo County, Solano County, Sacramento County, and other regions, and will help our graduates realize their dreams.”

“This is the fifth class that has graduated,” explained McMorrow, “and mind you, these folks are doing lots of different things. Some of them already have their own land, some are going to work for someone who has land, some will work other farmers, and some will go into a food-related business.”

 

“Still others will stay and lease small plots of land from us,” McMorrow commented, “to start their own farming business. Beginning farmers face huge barriers to getting started, the biggest of which is access to land, capital and infrastructure. So, to get their farming businesses started, California Farm Academy alumni are eligible to lease land at sites in West Sacramento, Davis and Winters at a very low cost.”

Ag Leaders on AB 1066 Consequences

California ag leaders hoped that Governor Brown would see how the AB 1066 overtime bill would actually hurt farmworkers and veto it. Now that the Governor has signed it, the following ag leaders weigh in on AB 1066 consequences: Norm Groot, executive director of the Monterey County Farm Bureau; Bryan Van Groningen, field manager for Van Groningen & Sons Farms; and Anthony Raimondo, a Fresno-based attorney who has been representing farmers and farm labor contractors for over 15 years, among them.

Norm Groot anticipated, “The end result of AB 1066 is a big move to mechanized harvesting, which probably means a change in some of the crops that we’re growing here simply because currently we can’t harvest lettuce or strawberries or some of the other vegetable crops by mechanized means. Lawmakers are forcing the hand of the growers to move into crops that are less labor intensive and thus, save the [labor] cost,” said Groot.

Groot noted the inaccurate AB 1066 assumption—that an increase in overtime hours and pay will result from its passage. “We will probably see their hours cut back to the eight hours a day and forty hours per week,” he explained, as stipulated in the law. “Growers will adjust their planning schedules to the amount of laborers that they think they have available for harvest. It’s not an automatic given that we’re going to see all these paychecks increase, simply because we’re putting overtime at more than eight hours a day or after forty hours a week,” Groot said.

Groot added that farmworkers are not in favor of losing 33% of their income at this point. “I think overall, the unions have been supportive of this particular change, but the unions do not represent the majority of the laborers or field workers at this point,” he said.

“I think if you were to ask the average field worker whether he wants to work ten hours a day and sixty hours a week, he would probably say yes. Field workers want that income. They know they work in a seasonal business; they have to earn their income when they can,” he explained.

“Our farmworkers, our employees, love to put in the extra hours because this is the time that they’re making wages. Our company is accustomed to paying overtime if that’s what it requires,” said Van Groningen, “and the majority of our workers are already satisfied with the existing compensation structure.”

But Van Groningen noted the problem lies in what is considered overtime. With a shorter workday, overtime compensation rates will kick in much earlier than in the past, which will end up being a tremendous cost to the employer. “That’s going to cause our farm to mechanize a little bit more to try to get through the harvest more bit quickly because [the cost] is going to become too big of a burden,” he said.

Growers want to help their employees as best they can, but Van Groningen predicts reduced hours may become a necessity. “It’s just smart business. We don’t want to cut hours, but if we’re forced to because our bottom line is starting to become an issue, that’s what we’ll have to seriously consider,” he said.

Anthony Raimondo foresaw the effects of AB 1066 could put California at a disadvantage in the global marketplace. “At the very least,” Raimondo said, “employers will be forced to evaluate where they can cut production costs.”

“The increased overtime in some industries is going to drive automation,” said Raimondo. “So you are going to lose jobs because now it’s worth it for people to do the research and development to have more automation, more machine-harvested crops and less labor.”

Raimondo also expects some employers to add more H-2A temporary agricultural guest workers to make sure hours stay low enough to prevent their costs from increasing. “In the end, this is really going to cost farmworkers in terms of their real wages and it creates a massive economic disadvantage for California’s agricultural industry,” he said.

Policies like AB 1066 become increasingly problematic as the global agricultural industry continues to become more competitive. “Increasingly, agriculture has become a global marketplace in which we compete against countries that do not maintain the same labor standards nor the same environmental standards that we maintain, so our agricultural industry continues to remain at an economic disadvantage with the rest of the world,” noted Raimondo.

Governor Signs AB 1066 With Good Intentions

TODAY, Governor Jerry Brown signed AB 1066, the overtime bill for farmworkers, despite pushback from agricultural groups and farmworkers in the state. Ian LeMay, director of member relations & communications of the Fresno-based California Fresh Fruit Association, anticipates that not only will farmers in the state lose, but farmworkers, exports, and possibly consumers will lose as well. 

For years, California farm employees accrued overtime pay only after working a 10-hour day, instead of an 8-hour day, like most other employees in California. AB 1066 changes the overtime rules for farmworkers by gradually lowering overtime thresholds in steps over the next four years so farmworkers will eventually earn overtime after an 8-hour day.

The California farm industry has appreciated the prior overtime policy, according to LeMay, because agriculture is not a typical 52-week type of job. The workload of farming ebbs and flows with the seasons, weather, cultural practices and tasks.Farmworkers

For instance, harvesting of crops such as strawberries, citrus and table grapes, normally occurs during short 2- to 3-week periods in the state and is accompanied by an increase in demand for labor. As one might expect, the need for labor declines during non-harvest and non-planting phases, to the extent that farmworkers may endure periods of no work, and hence, no pay. So farmworkers have appreciated the opportunity to work extra hours and earn overtime during busier phases.

Labor costs for California growers of all fresh fruit, avocados and many vegetable crops will be most affected by this change. “This is going to have a very, very big impact on crops that require a high degree of labor like our stone fruit, table grapes and the rest,” said LeMay, “It’s definitely going to change the way our members have to approach doing business,” he said.

“When you compare it to the other states in the union that we are going to have to compete with,” LeMay elaborated, “when you take into account recent changes in minimum wage, piece-rate compensation, increasing farm regulations and now overtime, it’s going to be very difficult to compete not only in a domestic market, but also internationally. That’s the disappointing part about this.”

LeMay also explained that over the last 40 years, the California legislature has crafted labor law to create the highest worker standards in the U.S. “California was the only state in the union that had a daily threshold for overtime of [only] 10 hours per day, and we were one of four in the union that had a weekly threshold for overtime of [only] 60 hours. So in terms of ag overtime, California was already the gold standard.”

And, although lawmakers intended AB 1066 to help farmworkers, LeMay noted, “ultimately, the measure will impact farmworkers the most because farmers in the number one Ag state will find a way to keep its bottom line from eroding any further.

“California farmers will need to solve the puzzle of how to achieve the same amount of work in fewer hours per day,” said LeMay. “They will consider hiring double crews, increasing mechanization in packing facilities, orchards and vineyards, and reducing farm acreage to match their workforce. Or, for those commodities that require increased labor, you could see a transition to commodities like nut crops that use less labor.”

LeMay explained that during down periods on the farm, farmworkers generally collect unemployment, which is based on gross annual income. Now, by giving the farmer an incentive to reduce worker hours, farmworkers’ unemployment compensation may decrease as well.

Furthermore, for the consumer who desires fresh local food from small farms, the phase-in schedule AB 1066 provides to smaller companies is actually a competitive disadvantage. “While AB 1066 allows small farmers—those with fewer than 25 employeesmore time to phase in changes,” LeMay asked, “why would a farmworker stay at small farm under the prolonged 60-hour per week overtime threshold rule, when he or she could work at a larger farm under the phased-in 40-hour per week threshold?”

Are consumers willing to pay for increased labor costs on the farm? “As the saying goes,” LeMay quipped, “generally farmers aren’t price makers, they are price takers. Consumers are usually unwilling to pay extra for their produce, so farmers usually have to absorb increased costs.”

“Economically,” LeMay summarized, “the legislature has taken us from high labor standards to economically disadvantaging farmers and farmworkers. Lawmakers are not paying enough attention to keeping California companies viable, sustainable and successful.”
