House to Take First Step Towards Full Ratification of USMCA

This Thursday, the House will take the first step towards full ratification of the renegotiated NAFTA known as the “US-Mexico-Canada Agreement” (USMCA). California agriculture exports $6.6 billion in goods to Canada and Mexico and supports more than 56,000 jobs.
 
Since NAFTA was implemented, U.S. agricultural exports to Canada and Mexico quadrupled from $8.9 billion in 1993 to $39 billion in 2017. After President Trump renegotiated NAFTA, the International Trade Commission determined that the USMCA would have a positive impact on the U.S. economy and a positive impact on U.S. agriculture. An additional $2.2 billion in exports is expected once this agreement is ratified.
 
Congress must pass USMCA to preserve the proven successes of NAFTA while enjoying greater access to dairy, chicken, and eggs. The agreement has positive updates for fruit exports, improvements in biotechnology, protected geographical indications, and strengthened sanitary/phytosanitary measures.

PLF Sues EPA Over Continued WOTUS Ruling

EPA Sued for Relying on Illegal Rules Following WOTUS Repeal

Albuquerque, New Mexico; October 22, 2019: A lawsuit filed today on behalf of the New Mexico Cattle Growers’ Association challenges the Trump Administration’s decision to rely on old, unconstitutional rules in the wake of the 2015 Waters of the United States rule’s repeal

Last month, the Environmental Protection Agency announced the repeal of thecontroversial 2015 Waters of the United States rule. The 2015 rule was the subject to numerous lawsuits, and five federal courts found that the 2015 rule was illegal.However, the EPA reverted toolder rules that are similarly unconstitutional. 

Represented by Pacific Legal Foundation, the New Mexico Cattle Growers’ Association is challenging this reversion to the pre-2015 rules. 

“The old rules that EPA is using now have been ruled unconstitutional by the Supreme Court,” said PLF Senior Attorney Tony Francois. “While it is good that EPA is repealing the 2015 rule, the older rules the agency is now enforcing have many of the same legal defects. The problem here is that for decades, not just since 2015, EPA has sought to use its Clean Water Act authority over navigable lakes and rivers to regulate puddles and dry arroyos on private property all over the country. This is the trend that has to be turned back.”

PLF has represented numerous people who were unfairly prosecuted under the rules on which EPA will now rely, including Andy Johnson, whose case President Trump discussed when he ordered the EPA to review the WOTUS rule in 2017.

New Water Year Brings Surplus!

Surplus for New Water Year Will Help Farmers in 2020

The Oct. 1 new water year, has brought the state a surplus— with statewide reservoir storage 128% of average.

“The wet 2017 was needed for our reservoirs to refill after an extended drought, and we’re hopeful that the upcoming water year will be generous,” said Mike Wade, Executive Director of the California Farm Water Coalition based in Sacramento.

The coalition educates consumers and others in the state about the importance of water for farms

“One of the things that we’re concerned about is allocations that have not seemed to keep up with the water supply, but we do understand there’s some question about environmental practices and enough water held over for stream flows, and those questions are something that we’ll have to contend with in the future,” said Wade.

With the carryover water that we have, we know that we’ll be in better shape going into this coming year than we have in some years in the past. But one of the things that are going to be helpful is if the Governor’s voluntary agreements get implemented regarding the State Water Resources Control Board’s Bay-Delta Plan on the Tuolumne River. “We have more reliability and understanding about how water is going to be used from year to year and how much will be available for water supply reliability, as well as the important environmental projects that are going on around the state,” he said.

“In December 2018, when the state Water Board adopted their Unimpaired Flow Plan, there was a lot of concern that that was going to take a lot of water. It would have taken a million or 2 million acre-feet of water potentially out of the available water that we have from year to year,” said Wade.

“The voluntary agreements represent a generational change in how we manage water and environmental projects in the state. I will provide more local control, more input from water users, and the ability to build the kinds of projects and do the kinds of stream restoration that not only help restore our ecosystem, but it makes water supply more reliable for farms, homes, and businesses around the state,” he said.

DPR Has Big Funding for Pest Managment Program

The Department of Pesticide Regulation’s (DPR’s) 2020 Pest Management Research Grant solicitation is now available

This year, the Pest Management Research Grant Program will allocate:

1-   $2,100,000 to fund projects that identify, develop, and implement safer, practical, and sustainable pest management alternatives to Chlorpyrifos. DPR will consider proposals requesting $150,000 to $500,000.

2-   $500,000 to fund projects that develop methods or practices to reduce risks associated with pesticides of high regulatory concern and/or are considered to high-risk and which can be incorporated into an IPM system. DPR will consider proposals requesting $50,000 to $500,000.

Concept proposals must be submitted by 5:00 PM PST on Monday, October 7, 2019.

Action Needed to Amend SB1

Urge your Representatives to AMEND SB 1

This week the Assembly will consider Senate Bill 1 by Senate Pro Tem Toni Atkins.

SB 1 proposes dangerous changes to how the state implements the Endangered Species Act (ESA) and will have devastating impacts on how water is managed in California.

The bill seeks to preserve environmental regulations against perceived rollbacks by the Trump Administration by empowering state agencies to immediately adopt the “baseline” standard in place before January 19, 2017 (the day before President Trump was inaugurated).

As currently written, SB 1 would lock in the existing biological opinions that determine how much water must flow out of the Delta to protect native fish species. This directly influences how much water is available to ALL water users south of the Delta.

The State and Federal agencies are currently in the process of updating the biological opinions, which will result in lower flows and more water for communities and agriculture. But, by locking in the existing biological opinions, SB 1 prohibits State from using the best available science to manage how water moves through the Delta.

Recent amendments do not go far enough to address the ESA provisions.

California Citrus Mutual and many other agricultural and business-sector groups have proposed constructive amendments to address these concerns.  The Pro Tem’s office, however, did not make substantive changes to the bill before it was passed out of the Assembly Appropriations Committee on Friday despite pressure from the Governor’s Office.

The Legislature will adjourn next Friday and it is imperative that SB 1 be amended THIS WEEK.

We are calling on our Assembly Members and Senators to urge the Senate Pro Tem to accept amendments to the ESA section.

SB1 Advances in Sacramento

SB1 Advances to California Assembly

The California Water Alliance announced today California Senate Bill 1, or SB1, by Senator Toni Atkins (D-San Diego), advanced from the California Assembly Appropriations Committee. SB 1 will now be considered on the California Assembly floor before the Legislature adjourns on September 13th.

Assemblyman Frank Bigelow (R-O’Neals), Vice-Chair of the Assembly Appropriations Committee, shared with the California Water Alliance, “I am disappointed that SB1 was released off suspense file with amendments that make it much worse for farming and California as a whole.”

SB1 effectively declares that California would adhere to laws governing clean air, water, endangered species and labor that were in place in January 2017, before the beginning of the Trump Administration.

“SB 1 is bad for farmworkers, farmers, and communities throughout the state of California,” said William Bourdeau, Chairman of the California Water Alliance. “Our environmental laws and regulations should be defined by current, sound science, not petty politics.”

SB1 would freeze the existing federal biological opinions. Future permits would be subject to outdated science and ineffective federal baseline measures, thus permanently, constraining the coordinated operations of the Central Valley Project and the ç.

Pesticide Air Monitoring Shows Low Numbers

2018 Air Monitoring Shows Most Pesticides Below Health Screening Levels

 The California Department of Pesticide Regulation (DPR) released air monitoring results indicating that most of the pesticides monitored in the DPR air monitoring network in 2018 were found below levels that indicate a health concern.

However, data from a separate two-year study of the pesticide 1,3-dichloropropene (1,3-D), a known carcinogen, shows air concentrations in Parlier (Fresno County) will require further action.  1,3-D is used to fight pests that attack a wide range of crops, including almonds, grapes, strawberries, and sweet potatoes.

“Air quality is fundamental for all Californians, and the latest data from DPR’ s air monitoring network shows levels of agricultural pesticides in most communities that are well within our public health standards,” said Val Dolcini, DPR acting director. “In many cases, the amount of pesticide in the air was negligible, but our scientists will continue to use this data to help DPR develop plans to reduce the presence of 1,3-D in the future.”

In 2018, DPR, with assistance from the California Air Resources Board (CARB) and the Santa Barbara County Agricultural Commissioner’s Office, monitored air concentrations of 31 pesticides and 5 pesticide breakdown products in eight agricultural communities. The monitoring stations are in Shafter (Kern County), Santa Maria, Cuyama (Santa Barbara County), Watsonville (Santa Cruz County) and Chualar (Monterey County), Lindsay (Tulare County), Oxnard (Ventura County) and San Joaquin (Fresno County).

The air-monitoring network, which began in 2011, was established to help expand DPR’s knowledge of the potential long-term exposure and health risks from pesticides in the air. California is the only state that monitors air as part of its continuous evaluation of pesticides to ensure the protection of workers, public health, and the environment.

The 2018 air monitoring report shows that of the 36 pesticides and breakdown products measured at the monitoring sites, most did not exceed screening levels or regulatory targets.

Other highlights include:
  • 8 pesticides were not detected at all and
  • 17 pesticides were only detected at trace level.

In January 2018, however, the air monitoring results showed that the pesticide 1, 3-D had a 13-week average concentration in Shafter of 5.6 parts per billion (ppb), which is significantly above the short-term (13-week) screening level of 3.0 ppb. A screening level is a level set by DPR to determine if a more detailed evaluation is warranted to assess a potential health risk.

DPR, along with the Kern County ag commissioner, investigated this detection and determined that it largely arose from a single application of 1,3-D made during this 13-week period. While this reading was not high enough to indicate an immediate health threat, DPR is consulting with other state agencies on next steps to reduce the exposures to 1,3-dichloropropene.

In addition to the 2018 annual air monitoring results mentioned above, DPR conducted a two-year air monitoring study of 1,3-D in Parlier (Fresno County) and Delhi (Merced County) from 2016 to 2018. The measured air concentrations in Parlier also exceed DPR’s screening levels and indicate that more mitigation is needed to reduce the exposures of this pesticide.

 These findings will be discussed at the next Pesticide Registration and Evaluation Committee (PREC) on July 19. The meeting will be live webcast.

Food Safety Inspections Coming

Operations with More than $500,000 Are First

Shelly Phillips is with the CDFA’s Produce Safety Program and supervises four inspectors with the eventual hiring of six more. She spoke about what to expect during a food safety inspection of farm operations at the recent Safe Food Alliance Conference in Monterey.

“These will not be surprise inspections. We will be calling and letting growers know that we want to inspect the operation and scheduling an appointment,” Phillips said.

From that point, an inspector will be following up with the farmer with logistic questions such as: “What are you growing?”, “When are you harvesting?”, and “What is the best time in terms of coming out to the operation?”

The goal is to have the inspection be collaborative between the farmer and inspector. It needs to be done during harvesting and handling conditions.

If an operation is unwilling or unresponsive, there could be an unannounced inspection.

“If we have called a grower three or four times and there are no return calls, and we have tried to reschedule multiple times, we may do an unannounced inspection because there might be a reason for the push back,” Phillips explained.

Also, if there are uncorrected produce safety issues, there could be an unannounced follow-up inspection.

“This will happen if we have been out to a farm under an announced inspection and there have been corrective actions that need to be observed, and there needs to be a follow-up; then there could be an unannounced inspection,” Phillips said. “We can also come out in response to a complaint or a foodborne outbreak investigation.”

Arriving On The Farm

“Let’s say the inspector arrives on a Tuesday … his or her identification will be shown, as well as a notice of inspection,” Phillips said. “They will want to speak to someone who is directly in charge. That person will be a farm manager or food safety manager, instead of someone not responsible for anything on a day-to-day basis.”

The inspector will explain the scope of the inspection based on what the grower is doing on the operation.

“If the grower is harvesting or packing, then we will be looking at that. We also want to see the grower training, [and] health and hygiene records.”

There is no set time length for the inspections, as it will depend on the size of the farming operation, as well as what the farm has prepared ahead of time for the inspector. Being prepared means having all food safety records available, and knowing where all water sources are. Also, if there are many observations that need to be corrected, then that could extend the inspection time.

Citrus Growers’ Response To Huanglongbing

Industry Committee Endorses Voluntary Best Practices

To provide California citrus growers with a strong toolbox of science-supported strategies and tactics to protect their orchards from Huanglongbing (HLB), the Citrus Pest & Disease Prevention Committee endorsed a set of best practices for growers to voluntarily employ in response to HLB in California.

The recommendations—which were developed based on a grower’s proximity to an HLB detection—represent the most effective tools known to the citrus industry at this time and are meant to supplement the California Department of Food and Agriculture’s required regulatory response. The best practices were developed by a task force consisting of growers from various regions across the state and scientists, all of whom were nominated by the Citrus Pest & Disease Prevention Committee.

Voluntary best practices were developed for growers in the four following scenarios:

  • Scenario 1: Orchards outside of an HLB quarantine area
  • Scenario 2: Orchards located between one and five miles of an HLB detection (within an HLB quarantine area)
  • Scenario 3: Orchards within one mile of an HLB detection but not known to be infected
  • Scenario 4: Orchards with HLB

The best practices vary in each scenario but all address: awareness, scouting for the Asian citrus psyllid, controlling Asian citrus psyllids with treatments, protecting young trees and replants, employing barriers or repellents, visually surveying for HLB, testing psyllid and plant material for HLB using a direct testing method like polymerase chain reaction (PCR), and tending to trees’ root health. The voluntary best practices in all four scenarios can be found at CitrusInsider.org.

While HLB has not yet been detected in a commercial grove in California, the disease continues to spread throughout residential communities of Los Angeles, Orange, and Riverside counties. HLB has infected more than 1,400 citrus trees, and 1,003 square miles are currently in an HLB quarantine area.

“Our state’s citrus industry has held the line against HLB since the first detection seven years ago. We should commend our efforts but must not forget the devastating impact HLB could have on our orchards and our livelihood,” said Jim Gorden, chair of the Citrus Pest & Disease Prevention Program and a citrus grower in Tulare County.

“We know the cost to manage the Asian citrus psyllid is far less than any potential costs or loss to the industry should HLB take hold throughout our state. These voluntary best practices are meant to serve as a box of tools so growers can use as many as are feasible for their operation in order to limit the spread of the psyllid and disease,” said Keith Watkins, chair of the task force that developed the best practices and vice president of farming at Bee Sweet Citrus.
