Jim Costa, Congressman for the 16th Congressional District of California that covers all of Merced County and parts of Fresno and Madera Counties and includes vast areas of agricultural land, is not happy with the water situation in California. Costa stated, “To be sure, we are still in a water crisis even though we have had some good [wet] months.”

“Sadly those good months have seen too much of that water going out to sea—as opposed to getting into the San Luis Reservoir and providing water for our Valley—whether for the East side or the Westside. It is a fight that I have been engaged in for years, but most recently, I have been trying to ensure that we are pumping at the maximum levels even under the flawed biological opinions that we are having to contend with.”

Costa explained that while the pumps have been turned up over the past month, sometimes to the maximum level, “the San Luis Reservoir is only 51% full, and now we are are still looking at a 5 percent water allocation for Federal water users.  This has been avoidable, and it is unconscionable and immoral. Let me repeat that, it has been avoidable, and it is immoral and unconscionable that we, in fact, are in this predicament. It is largely because we have failed to take advantage of the El Niño months of December and January.”

Assessing our winter water losses,Costa remarked, “Since January 1st, we estimate that we have lost over 440,000 acre-feet of water. This freshwater440,000 acre-feetwould make a big difference to our Valley, which has been water-starved from a combination of 4 years of drought, plus the flawed biological operations of the Federal and State Water Projects. So, we have to fix this broken water system, bottom line.”

California Ag Today staff interviewed Ryan Jacobsen, CEO and executive director of the Fresno County Farm Bureau moments after the Bureau of Reclamation announced only 5 percent of contracted water would be allocated to Federal surface water users south of the Sacramento Delta during this El Niño year.

California Ag Today: Forget how you feel about the Bureau of Reclamation’s initial 5 percent allocation for Federal water users. How many times can we say, “Frustrated?” 

Jacobsen: Absolutely just despicablethe announcement we heard earlier today. The frustration is that we’ve continually been told over the last couple of years with zero percent water allocations that it’s been Mother Nature.

Even though it’s not necessarily the big bang year we were hoping for in northern California, Mother Nature provided. We’ve seen the reservoirs overflowing. We’ve seen the reservoirs flood-releasing, and here we are with a five percent allocation. We saw outflows in the delta this winter that exceeded the 300,000 acre/feet a day, and yet we weren’t doing anything to capture it. So, it’s just frustration, frustration, frustration that here we aremore of the sameand what does this mean long-term for California agriculture? We can’t be viable without a surface water supply, and when Mother Nature provides, unfortunately the federal government’s not trying to collect it.

California Ag Today: What is going on? Why are they doing this? Do you have any theories?

Jacobsen: Obviously, it has so much to do with the environmental side and the belief that the federal government is doing all they can to protect these species up there. We have seen that it’s doing no good; the fish species are seeing no recovery; it’s actually going in the opposite direction. It is plain mismanagement. The unfortunate part is sound science isn’t even going into this right now; it is purely the emotional side of whoever decides to pull the trigger on the federal side. And here we are on the resulting end, losing millions and millions of dollars in our economy, idling more farmlandthe most productive farmland in the countryin the worldand losing the jobs that are associated with it.

California Ag Today: You speak brilliantly on this whole situation. Way more water has flowed out to the ocean than needed for the protection of any of the species or the environment, so who are they listening to?

Jacobsen: Right now, this is simply the administration’s decision. Reclamation falls under the federal side of things, so obviously, ultimately, it lays on the President’s desk. If we talk about resolution: by 9 a.m. tomorrow morning, we could see a resolution to this whole issue. If Congress would get their act together and pass some kind of bill, get it on the President’s desk and get it signed, we could see some resolution.

Unfortunately, here we are, April 1:  a good portion of the precipitation season is now behind us, the high flows through the delta are pretty much over. We still have healthy reservoirs up North, but unfortunately it doesn’t mean anything for us down here because we can’t convey it through the Delta to get here. That lack of  and the lack of ability on the federal side to make the decisions that would allow us to pump that water makes this just another year of doom and gloom. Again, how much more of this can we take? I think the long-term outlook for those farmers with permanent crops who have tried to scrape by, has to be, “Is this even viable for us to continue to do this anymore?” ‘Because Mother Nature provided, and yet we don’t see the water.

California Ag Today: Very bleak. Ninety-five percent of normal snowfall, too.

Jacobsen: The percentages in northern California, while good, weren’t the El Niño banner year we were expecting. The season looked bright, like it was going to be good. Yet, the fact of the matter is that during the months of January, February and March, when these just incredible numbers of high water flows were going through the Delta, pumps were pumping in single digits. And that’s not even close, or anywhere near where they should have been.

I think the misconception is when we talk about the water that is taken from the Delta, it’s such a small percentage, particularly during those high-flow times; it would have meant no difference to water species. It’s just a frustration that we continue to be bombarded by these environmental restrictions that are having no good effect on the long-term viability of these species they are trying to protect.

California Ag Today:  What is the economic impact of these water cutbacks on the Central Valley?

Jacobsen: Well, when you look at the five percent allocation, we are ground zero. Fresno County, right in the heartland of the Central Valley, is ground zero. We are going to see probably in excess of 200,000-250,000 acres of land continue to be fallowed and the loss of the tens of thousands of jobs associated with that, and millions, tens of millions of dollars. It’s obviously a very dire situation when it comes to long-term viability here in the Valley.

California Ag Today: Because they are going to hear a lot of outrage from us, do you think the Bureau of Reclamation would go to a 20 percent water allocation? Farmers must be thinking, “We got to get the seeds ordered today for the crops.” Is there any hope for an increase in water, or do you think farmers just can’t bank on it?

Jacobsen: It’s already too late. For this season, it’s already too late. It is April 1 already, and, unfortunately, this is not a joke. This decision is about one month-and-a-half late. I think the Bureau of Reclamation was hoping the numbers would improve magically. They didn’t.

The five percent allocation, while said not to be our final allocation, is likely to be close. It won’t go up to 20; it won’t go up to 15. Maybe if we pray enough, it may go up to ten, but that would be on the high side. Right now, it looks very realistic that five percent is where we end up, where we are going to stand for the year.

California Ag Today: Okay, I know growers who have planted tomatoes in Fresno County, thinking, “Hey, we gotta get water.” They’re not getting it.

Jacobsen: They’re not getting it, no.  And lack of surface water supply continues to make a huge dent in our groundwater supply, so this just can’t continue the way it is going. Plus, upcoming implementation of the Sustainable Groundwater Management Act (SGMA), combined with the lack of federal surface supplies, will absolutely hammer farms here in the Valley.

Earlier TODAY, the United States Bureau of Reclamation (USBR) stunned the farming industry by announcing a  5% water allocation for most of the farmland to the Westlands Water District on the Westside in the Central San Joaquin Valley. This single digit water allocation to the comes during an El Niño year of wet weather, following four years of drought and restricted water deliveries to Westlands of 40% in 2012, 20% (2013), 0% (2014) and 0% again (2015).

Westlands Water District LogoLes Wright, agriculture commissioner for the Fresno County Department of Agriculture—ground zero for agricultural water cutbacks, said, “I can’t think of a word to describe how I am feeling about our federal water managers. It’s despicable what they’re doing to this Valley.”

“You have two major reservoirs in flood stage,” said Wright, “but they are refusing to turn the pumps on. It’s like they want to starve out the Valley, its farmers and communities. Agriculture is the major economic driver for the Valley communities, and they’re doing everything they can to drive the people out of this Valley.”

Established in 1902, the USBR, according to its website, is best known for the building of more than 600 dams and reservoirs, plus power plants and canals, constructed in 17 western states. These water projects led to homesteading and promoted the economic development of the West.

The USBR website reads, “Today, we are the largest wholesaler of water in the country. We bring water to more than 31 million people, and provide one out of five Western farmers (140,000) with irrigation water for 10 million acres of farmland that produce 60% of the nation’s vegetables and 25% of its fruits and nuts.”

Yet, some Western farmers have received a 0% water allocation for each of the past two years, and now may receive only 5% this year. Already, Westlands Water District reports over 200,000 acres of prime farmland in the district have already been fallowed.

“Reservoirs throughout the state have been filling,” said Fresno County Farm Bureau CEO, Ryan Jacobsen, in a statement TODAY. “However, the government’s restrictive interpretation has resulted in the permanent loss of 789,000 acre-feet of water,” said Jacobsen. “Since December 2015, more than 200 billion gallons of water have been forever lost to the ocean, with almost no water being allocated to agriculture.”

Commissioner Wright reflected, “President Obama and both California senators have been here in the Valley, on the ground. They have seen what we are doing. They recognize the crisis; yet they refuse to use their authorities to correct the situationin a year when we’re dumping millions of gallons of water to the ocean.”

Wright explained the federal government is sending fresh water to the ocean in excess of what is needed for the environment and the protected species. “They are just wasting the water,” he said, “and yet, we have the Governor telling us to cut back 25% to 35%. And all of that water we saved last summer and in the last year, they have more than doubled the waste.”

“Where is the governor on this issue?” Wright asked. “It is despicable what the government is doing to its people.”

Mario Santoyo: Recent Temperance Flat Dam Memo is Misleading

A recent memo to the City of Hanford, issued by the Townsend Public Affairs office in Washington D.C., stating the Temperance Flat Dam proposal may not be eligible to receive Proposition 1 funds, was deemed “misleading” according to Mario Santoyo, executive director of the 11-member board of the Joint Powers of Authority that oversees the proposed Temperance Flat Dam.

The U.S. Department of the Interior Bureau of Land Management’s 2014 decision to recommend designation of an 8 mile segment of the San Joaquin River (accompanied by a restricted-use river corridor extending 0.25 miles from the edge of the identified river segment) that falls in the footprint of Temperance Flat as a “National Wild and Scenic River,” has been a concern for awhile, noted Santoyo. “This memo is very misleading,” he said. “It has nothing to do with state bond funding”—California’s Proposition 1 (Prop 1), the legislatively-referred Water Bond (Assembly Bill 1471), passed by state voters on the November 4, 2014 ballot.

“But if the [recommended] designation stays in place,” Santoyo continued, “it would prevent us from building Temperance Flat with any funding. Whether with state funding, federal funding or Prop. 1 funding, it does not get builtperiod,” Santoyo said.

“To be eligible for Prop 1 funding, you have to have a feasibility report,” said Santoyo. “In other words, the federal government has to determine if the project is feasible under Prop. 1 money.” However, doing the feasibility report is part of doing the environmental paperwork. And, if at the end something changes on the conditions that were originally evaluated, then the project could be determined unfeasible.”

“But none of this has happened,” emphasized Santoyo, as the recommendation of this San Joaquin River segment to be designated National Wild and Scenic River has not yet been legislatively authorized. “We are perfectly aware of that hurdle. The designation is one of many things that we have to deal with.”

Santoyo said there would be a discussion this week with the regional director of the Bureau of Reclamation to talk about the Scenic River designation, the National Environmental Policy Act (NEPA), and the California Environmental Quality Act (CEQA), as well as technical partnership. “There are a series of things that need to happen to keep advancing the ball,” Santoyo said.

And even though the proposed Sites Reservoir is not subject to the Scenic River designation, it has not passed the feasibility study. “So it even has its challenges,” said Santoyo.

“All the projects have big challenges, but the question is: Do you keep moving forward regardless of how hard the issues are or do you just fold the first time you hit a bump? We are not folding; we are moving forward,” Santoyo said. “Either we shoot hard for currently available options or we shut down and do nothing. Why go through 10 years’ worth of effort to give us this opportunity and not take a shot?” he asked.

Feinstein Urges President to Increase Delta Pumping

Feinstein Calls on President to Direct Federal Agencies to Increase Delta Pumping

 

Washington—Senator Dianne Feinstein (D-Calif.) TODAY called on President Obama to direct federal agencies “to maximize pumping in the Sacramento-San Joaquin Delta to the maximum extent allowed under the Endangered Species Act and biological opinions.”

Feinstein wrote in her letter to the president: “I believe that this year’s El Niño has highlighted a fundamental problem with our water system: A dogmatic adherence to a rigid set of operating criteria that continues to handcuff our ability to rebuild our reserves. We need a more nimble system. That’s why I included $150 million the past two years in the Energy and Water budget—so that decisions would be based on real-time data, rather than relying on intuition.”

Dear Mr. President:

I ask you to direct the Bureau of Reclamation, Fish and Wildlife Service, and National Marine Fisheries Service to maximize pumping in the Sacramento-San Joaquin Delta to the maximum extent allowed under the Endangered Species Act and biological opinions. Water flows in the Sacramento River are the highest they have been in four years. Just last week, flows in the Sacramento were as high as 76,000 cubic feet per second. We’ve only seen flows that high twice in the past ten years, and not once during this drought. Yet the Bureau of Reclamation and Fish and Wildlife Service are now considering reducing pumping due to concerns about larval smelt.

Despite these high flows, rather than pumping as much water as possible without undue harm to the smelt, pumping levels remained constant for the past month (see Chart B). Coupled with the fact that only three individual smelt were caught at the pumps this year, and that the most recent trawls revealed no Delta smelt in the south Delta, it seems to me that the agencies operate the system in a manner that may be contrary to the available data, culled from what is already a limited monitoring regime. I understand that the biological opinions impose a ceiling of -5,000 cubic feet per second, but the agencies have the discretion to exercise at least some flexibility to pump above that level.

To put this all in context, between January 1 and March 6 last year, 1.5 million acre-feet of water flowed through the Delta and 745,000 acre-feet were pumped out. During the same period this year, 5.5 million acre-feet of water flowed through the Delta, but only 852,000 acre-feet were pumped out (see Chart A). If we can’t increase pumping during an El Niño year, then when else can we?

The agencies have also put California and the communities that depend on this water in a Catch-22: Pumping is reduced when there are concerns about the presence of smelt caught as far away as 17 miles from the pumps. Yet agencies will also reduce pumping due to the absence of smelt, based on the idea that historically low smelt populations make detection difficult.

I believe that this year’s El Niño has highlighted a fundamental problem with our water system: A dogmatic adherence to a rigid set of operating criteria that continues to handcuff our ability to rebuild our reserves. We need a more nimble system. That’s why I included $150 million the past two years in the Energy and Water budget—so that decisions would be based on real-time data, rather than relying on intuition.

There are real-world consequences to the decisions being made in the Delta. 69 communities in the Southern San Joaquin Valley reported significant water supply and quality issues. And land is caving, bridges collapsing, as a result of overdrawn ground wells and subsidence. That’s why we need to make sure we’re using every possible tool to make the right choices. Basing pumping decisions on better science and real-time monitoring is the least we can do.

California State Senator Anthony Cannella, (R-Ceres), who represents District 12, the Westside of the Central San Joaquin Valley from Modesto to Coalinga, knows how growers must feel about so much fresh water from recent rain and early snowmelt flowing out to the ocean instead of being stored for future use. Cannella, who is currently serving as vice chairman of the Agriculture Committee said, “Obviously growers are out there; they have their life savings out there; they have been relying on water from the State Water Project or they have been relying on reservoirs; and the state has been taking more and more of their water due to ESA restrictions.”

“If farmers do not have surface water again this year,’ he continued, “they are going to pump from the groundwater. But state and federal officials do not see the connection that no surface water means more groundwater pumping. It would be much more sustainable if farmers could receive more surface water instead of having it flow out to the ocean.”

Cannella said, “Water regulators operate in silos. On one hand, they say groundwater has to be at an equilibrium; and, on the other hand, they say that they cannot pump much fresh water into reservoirs. They don’t combine the two; they don’t connect the two; and I think that is wrong.”

“If you are going to regulate or take away surface storage, there will be an impact on groundwater,” explained Cannella. “But the state does not operate that way, and that is why we are having the problem we are having,” he said.

Interior Assesses California Water

U.S. Department of Interior’s Tom Iseman Assesses California Water

Tom Iseman, deputy assistant secretary for water and science at the U.S. Department of the Interior, in an exclusive interview with California Ag Today’s farm news director, Patrick Cavanaugh, assessed how California is faring given the drought.

Cavanaugh:  I see you as someone who focuses on not just solutions but also the issues and tragedies caused by the extended drought in California. From your perspective, how is California doing and how could things be better?

Iseman:         First of all, I think California is obviously on the leading edge for a lot of reasons, but the state is in the midst of an extended drought. So it is really forcing us to be smarter about how we address these water scarcity challenges. I have been very impressed with the way we have been able to really work together—the Bureau of Reclamation working with the state, the water users and the conservation groups—to think about how we can stretch our limited water supplies to meet these different purposes.

Cavanaugh:  Obviously the country is not able to build another Hoover Dam, but does the Interior understand that we need more storage in California for the rainy days?

Iseman:         Absolutely. There are different ways to do it, so we are looking at a number of projects. One is raising Shasta Dam; one is a new reservoir possibly on the upper San Joaquin River (Temperance Flats); and Sites Reservoir.

Cavanaugh:  But those projects are a long way off, and they may never be built. What can California do now to increase its water portfolio?

Iseman:         There are smarter ways we can build smaller-scale storage and new ways to operate our facilities to stretch water supplies to our advantage.

Cavanaugh:  Could you talk about how we can use water differently? Desal is more expensive water, but water needs to be more expensive. When water gets more expensive, people conserve more, right? Talk about your vision of desal in America, particularly in California.

Iseman:         Generally, clean water technology is a big part of what we need to be doing. It is not just building new storage; it’s being smarter with what we have. So, technology is a great way to do that. We have desalination, water recycling and water reuse. Having these options creates an opportunity for more partnerships. So now you can have cities recycling their water and sending their water supply to agricultural water users—a win-win situation. The city gets some revenue and deals with its wastewater, and agricultural water users get a new supply. That is the way we should be thinking—about the possible partnerships to take advantage of these options.

Cavanaugh:  People building desal plants in cities like Santa Barbara, mothballed the plants when the rains came. We need to make desal part of the culture of these cities located on the ocean. I mean, does the Department of the Interior see that as a rational thing to do?

Iseman:         It’s interesting. Obviously it has been done in other places, and they have invested quite a bit of money here in California. It comes down to economics; we don’t make the decision about whether a city builds or doesn’t build a desal plant, but it is part of the water supply list, potentially.

The challenges with desal is just the cost right now and how much energy and waste it can produce. And they are comparing that to the other options out there. Are there other technologies out there that we can use? Are there water markets or water rights I can acquire? Is there potential for new storage? I think the cost will help sort that out.

The part that cost doesn’t address in some ways—and it can be built in—is the uncertainty. One thing, I think, about a desal plant that people like is that you know there is going to be a water supply if you are on the ocean. And if you have the money and can generate the energy, you can get the water. As you see more uncertainty in our climate and in our existing water supplies, that would be one argument in favor of desal.

Cavanaugh:  It is stable.

Iseman:         Yes, and we need reliability.

Cavanaugh:  Well, you talked about the cost and the economics, but we all need to pay more for water, and I’d be the first one. It would make everyone conserve more, right?

Iseman:         Absolutely.

Cavanaugh:  Maybe, raise the cost of water $10 a bill?

Iseman:         Well, I’m not going to say we are going to raise people’s water rates, but if you talk to the industry and look at the future of the industry, a lot of people say, ‘People need to pay more for water.’ That is how you get the investments.

The federal budget is constrained; they are not going to be there when we are going out and building Hoover Dam in ten years. We just don’t have that kind of resources anymore. So the question is, how do you get more revenue stream in to help contribute to the cost of those investments? And that goes back to rates. And at some point, we will have to decide how much we pay for water and how much we value our water.

Cavanaugh:  Thanks for being aware of all this. Are you encouraged we will find solutions?

Iseman:         We talk about California everyday; we are all very aware of the things that are happening. But I really gained an appreciation of the innovation, the energy and the cooperation of people here—the commitment they have in dealing with these issues. I was glad to be a part of it.

Agriculture Among 2015 GEELA Recipients Honored

Twelve California organizations received the state’s highest environmental honor, the Governor’s Environmental and Economic Leadership Award (GEELA), in a ceremony last evening in California Environmental Protection Agency headquarters, Sacramento. Established in 1993, GEELA is awarded to individuals, companies and organizations that use sustainable business practices to conserve energy, reduce waste or prevent pollution while contributing to their local economy.

“This year’s GEELA recipients made extraordinary gains in sustainability, waste reduction and conservation,” said Secretary for Environmental Protection Matthew Rodriquez. “The winners also demonstrated their environmental achievements resulted in greater efficiency and economic benefits that spread beyond their organizations.”

The 2015 GEELA winners are:

Prather Ranch (Shasta County) for minimizing waste from animal food products and creating conservation easements to protect endangered species.

Sonoma County Winegrape Commission (Sonoma County) for advancing the goal to make Sonoma County the first fully sustainable wine region in the country by 2019.

Clean Water Action and Clean Water Fund (Alameda County) for its “ReThink Disposable” source reduction program that has helped 100 businesses and institutions reduce single-use disposable food and beverage packaging products by an average of 70 percent.

Sacramento Water Forum (Sacramento County) for its unprecedented effort to manage water temperature in real-time to protect incubating .. As a result of the partnership with U.S. Bureau of Reclamation, 95 percent of the brood survived.

San Diego County Regional Airport Authority (San Diego County) for annual enhancements of its waste reduction programs, including expanding food composting to all concessions, and recycling of air conditioner condensation.

Solana Center for Environmental Innovation (San Diego County) for its “Organics Marketplace” waste diversion program that has kept more than 16,000 tons of organic waste out of regional landfills, resulting in $20 million a year in savings.

Metropolitan Water District of Southern California (Los Angeles County) for water conservation education programs for pre-K through college level, used by more than 300 schools.

South San Francisco Scavenger Company and Blue Line Transfer, Inc. (San Mateo County) for the dry fermentation anaerobic digestion facility that is first in the nation to create a closed loop renewable fueling station from the processing of organics.

Stanford University for a new 70 percent more efficient energy system.

Orange County Department of Education and Orange County Waste & Recycling for “Project Zero Waste,” a K-12 education program at 200 schools. 

REV for peer-based community learning to help organizations adopt a mindset of sustainability and improve efficiency.

City of Anaheim for the Anaheim Regional Transportation Intermodal Center, the world’s first LEED Platinum designed transit station.

The finalists were chosen by a panel of judges that included the Governor’s Office and the secretaries of the California Environmental Protection Agency; the Natural Resources Agency; the Department of Food and Agriculture; the State Transportation Agency; the Business, Consumer Services and Housing Agency; the Labor and Workforce Development Agency; and the Health and Human Services Agency.

Speaking at last week’s California Water Commission meeting in Clovis about the need for water storage, Madera County supervisor David Rogers voiced the solution to land subsidence caused by groundwater depletion:  the Temperance Flat Dam.

“We’re losing our groundwater so rapidly, the soil is sinking beneath us in a geological process called subsidence,” Rogers said. “Water is flowing out to the ocean from the San Joaquin River system, when in reality, that water needs to be delegated and allocated to farms so they don’t have to pump groundwater.”

“We’re losing the river and it’s a moot issue. We need surface water delivery; that has to happen. We cannot continue this way or we will lose the river, the communities, and the farms. There’s no question that Temperance Flat is the answer to this problem.”

Central Valley land subsidence is not new. In the mid-1900s, subsidence of the soil was occurring much like it is today. “Between 1937 and 1955,” Rogers explained, “the ground sank 28 feet in Mendota, Fresno and Madera Counties and similar regions.”

The federal Central Valley Project (CVP), which stretches 400 miles from north to south, was organized and built back then to solve the extreme and recurring water shortages, land subsidence and flooding. Operated by the U.S. Bureau of Reclamation, and considered one of the world’s largest water storage and transport systems, the CVP now consists of 20 dams and reservoirs, 11 power plants, and 500 miles of major canals, as well as conduits, tunnels, and related facilities.

“The very purpose of the CVP,” Rogers emphasized, “was to stop the ground from sinking beneath our feet. We are currently in the same situation, and the much-needed extra storage is going to be created by the Temperance Flat Dam. It is the solution. It is what this Valley needs. We need it now. We don’t need it tomorrow; we need it—yesterday!”

U.S. Bureau of Reclamation Releases Shared Water From Trinity Reservoir Despite Making Claims Of “California’s Historic Drought”

The San Luis & Delta-Mendota Water Authority (Authority) along with Westlands Water District, according to their press release, has filed a lawsuit in federal court to stop the Bureau of Reclamation (Reclamation) from releasing Central Valley Project (CVP) water from the Trinity Division to the Klamath River.

Yesterday, Reclamation announced the release of up to 88,000 acre-feet of CVP water from Trinity Reservoir in the hope of aiding returning non-listed Chinook salmon with the optimism of diminishing the effect of a naturally-occurring disease endemic known as “Ich” (pronounced “ick”) to the Klamath River system to which the Trinity River is connected. This action, which is outside of Reclamation’s authorized place of use, is a repeat of a similar action taken last year with the intention to help avoid an outbreak which has only been documented to have occurred once in 2002. Since 2000, a significant supply of water has been set aside each year from the Trinity Reservoir for fishery protection purposes. Specifically, over the past four years, this has equated to more than 200,000 acre-feet of water lost that was literally flushed down the Lower Klamath River.
“As our state is faced with a water supply crisis affecting every sector of people, businesses, and communities, an action like this is unthinkable. This will cause irreparable damage to drought-stricken communities already facing water restrictions,” said Dan Nelson, executive director of the San Luis & Delta-Mendota Water Authority.
The CVP and State Water Project (SWP) provide water for more than 25 million Californians who depend upon a reliable water supply. In the 50-year history of the Projects, water deliveries have never been lower–the CVP is experiencing its second year of a zero water allocation and the SWP sits at a mere 20 percent water allocation.
Reclamation is once again choosing to ignore the harms of its actions through the issuance of a “Finding of No Significant Environmental Impact” (FONSI) that hasn’t been properly analyzed. Further, Reclamation’s decision to release 88,000 acre-feet of CVP water for the Klamath River is a sad irony given that Reclamation is currently unable to meet its legally-mandated obligations within the CVP and SWP.

“The hardworking people of the State of California have been directed by state and federal agencies to conserve water in the form of dying lawns, fewer showers, unplanted fields, trees uprooted or turning brown, and community wells drying up. Yet Reclamation, which has been unable to deliver any water to farmers, has decided to release tens of thousands of acre feet in an arbitrary manner that the courts have previously held to be unlawful.” said Tom Birmingham, general manager of the Westlands Water District. “The fact that 88,000 acre-feet can be casually released without regard to the potential impacts on the environment, including at risk-species in the Sacramento River and the Delta, is a gross mismanagement of the state’s water supplies. The action filed today is intended to compel Reclamation to comply with its mandatory duties,” said Birmingham.
“During a time when we are experiencing the worst water management challenges in decades, when communities and agriculture throughout the state are suffering severe impacts that have negatively affected our economy, the labor force and the environment, the decision by the Bureau of Reclamation to repurpose precious Central Valley Project water resources to augment Klamath flows for non-endangered fish, an action that is of questionable benefit, is both irresponsible and incomprehensible. While the needs of cities, family farms, and endangered species that rely on CVP resources continue to go unmet, the reallocation of the Project’s limited supply of water defies all logic,” said Jeff Sutton, general manager of the Tehama-Colusa Canal Authority, an organization that represents seventeen Sacramento Valley water districts that hold CVP water service contracts, that are also highly critical of the action being undertaken by the Bureau of Reclamation.
The water planned for release is enough to farm 31,000 acres of food, or to serve the domestic needs of more than 175,000 families for an entire year. The devastating effects of the drought will be felt for decades to come especially if arbitrary decisions like these continue.
