$9 Per Hour Minimum Wage Starts Next Week

Starting July 1, the California state minimum wage increases to $9 per hour, a hike that growers say will result in more challenges on the farm and higher costs overall.

Monterey County strawberry grower Ed Ortega said, “In agriculture, nobody can pay just minimum wage.

“People will find a job doing something else that is much easier work than working in agriculture for minimum wage. They’d rather go and flip burgers for nine bucks,” Ortega said. “Our work demands more than a minimum wage employee, so every time the minimum wage goes up, the whole ladder in our entire pay structure goes up. There’s no such thing as paying the bottom guy more and not the top guy. The whole ladder rises.”

California’s minimum wage increase to $9 per hour is a result of the passage of Assembly Bill 10 by Assemblyman Luis Alejo, D-Salinas, in 2013. AB 10 also provided for a second hike in the California minimum wage to $10 per hour on Jan. 1, 2016.

Bryan Little, California Farm Bureau Federation director of labor affairs and chief operating officer of the Farm Employers Labor Service, said raising California’s minimum wage might have happened through a ballot initiative had AB 10 not become law last year.

Proponents of increasing the minimum wage argue it is needed to reduce poverty, while business groups and those opposed believe raising the hourly minimum wage would increase business costs and jeopardize California’s economic recovery.

“The majority of farmers already pay their employees much higher than minimum wage, so when these changes occur, employees making more than minimum wage expect to stay that much ahead of the increased rate,” Little said. “In the short term, it will increase costs to employers, but the labor supply is tight right now, so workers are already able to demand fairly high wages, but the increase still impacts operating costs and business profitability.”

Phil Martin, professor of Agriculture Economics at the University of California, Davis, confirmed that higher minimum wages affect some employers and workers more than others.

“Most farm employers have a wage structure, with some employees earning the minimum wage and others more. If the minimum wage rises by $1 an hour, workers earning more than the minimum wage normally expect a similar increase in order to keep their status in the wage hierarchy,” Martin said. “Employers often respond to higher wages with productivity increasing steps, from providing tools that enable workers to work faster to harvesting fields and orchards less often.”

Martin added that fewer new immigrants have already put upward pressure on farm wages and encouraged more use of labor-saving and productivity-increasing machines.

The new minimum wage has triggered other wage concerns for agriculture employers, Little said.

“A number of other costs associated with employing people are tied to employee earnings, like Workers’ Compensation and Unemployment Insurance; the increase in the minimum wage will directly and immediately impact employers’ costs for that. Also, if farm employers augment their workforces by bringing in farm labor contractors, the farm labor contractor is likely to increase the price of the workers they provide to cover that minimum wage increase and related costs.”

Farm labor contractors can be more efficient, and employ people year-round and spread their employment costs across more jobs than a farmer who employs a small number of people can, Little added.

“Farmers face several challenges in 2014, including implementing the Affordable Care Act and dealing with the effects of the drought,” Martin said.

This season, when it comes to the availability of employees, Ortega said, he is again experiencing a shortage of workers.

“We are experiencing the normal shortage that we experienced last year, which is a pretty extreme shortage of labor. Those who have less of a crop to harvest have a more severe labor shortage than those who have a crop to harvest,” Ortega said.

Whether a farm will attract the workers that are needed, Ortega said, depends on the size of the ranch and whether there is enough work to keep employees working. Smaller farms will have more limited opportunities.

“Any farmer who is experiencing a decrease in the water supply will also be experiencing extreme pest pressures, and if you have increased pest pressure, it means higher cost to the farmer,” Ortega said. “It’s an exponential factor. It’s not just raise the minimum wage a dollar; the associated costs go a lot higher than that.”

California is one of 18 states and the District of Columbia that have minimum wages above the federal minimum of $7.25 an hour and California’s $10 minimum is likely to be among the highest in the nation in 2016. Washington currently has the nation’s highest state minimum wage at $9.19 an hour.

UC Gets FAA Clearance to Research Drone Use in Ag

A UC laboratory at the former Castle Air Force Base in Atwater received clearance from the Federal Aviation Administration to fly dones at the Merced County Radio Control Club’s field, reported Thaddeus Miller in the Merced Sun-Star.

The unmanned aircraft are part of a project funded by the UC Division of Agriculture and Natural Resources that aims to study the possible use remote controlled aerial imaging to provide real-time information to farmers about water use and crop health.

The project leader, David Doll, UC Cooperative Extension advisor in Merced County, has put together a project team that includes UC Merced professors and graduate students, and UCCE advisors and staff.

Drones are also known as unmanned aerial vehicles (UAVs). Doll believes small, basic UAVs can provide a platform for imaging hardware that can vastly improve crop surveillance to enhance water usage and pest control.

Doll’s project will test the potential of UAVs for water management and pest monitoring. He also plans to write a curriculum to extend information to farmers and demonstrate the use of small, remote controlled aerial vehicles as imaging platforms.

UC Merced also has other plans for using drone technology in research. They are seeking FAA approval to fly the aircraft over the university’s protected land, which includes 6,500 acres of grassland and vernal pools.

Dan Hirleman, dean of UC Merced’s School of Engineering, said the university’s use of drones and development of new technology could set it apart from other schools.

“We’re kind of at the ground zero for a lot of what’s going on in those areas,” he said. “It’s just a perfect fit with our sustainability theme and the application area.”

Homeowners: Your Gardeners Need License to Apply Pesticides

Homeowners Urged To Make Sure Gardeners Who Apply Pesticides Have License

The California Department of Pesticide Regulation (DPR) is urging all homeowners to check that their maintenance gardener (landscaper) has a state maintenance gardening (MG) pest control business license from DPR if they are occasionally applying pesticides on their lawns. Homeowners can do so on the DPR website’s License and Certificate Holder List Page.

“Homeowners may not realize that maintenance gardeners are applying chemistry to their lawns,” says DPR director Brian Leahy. “We want to try and ensure they are doing so in a responsible manner.”

The license ensures that the person applying pesticides has been properly trained to use them on lawns and garden areas. If used properly, pesticides should not cause harm to humans or pets. However, improper use may result in illnesses or environmental problems.

Pesticides used on lawns and gardens may be washed to street storm drains and into local rivers, streams and even sensitive wetlands miles away. This may impact aquatic life.

“Your lawn may only be a small piece of land, but collectively, California lawns amount to many acres,” said Leahy. “Homeowners can play a significant role to reduce the amount of pesticide pollution (runoff) from lawns that are entering our waters through storm drains.”

Under California law, anyone who applies pesticides, even if it is only incidental to other maintenance gardening tasks, must have this DPR maintenance gardening pest control business license and be registered with the local county agricultural commissioner’s office.

In California, there are about 100,800 landscapers employed in the public and private sector who are responsible for maintaining homes, parks, golf courses, schools and plantings around malls, offices, restaurants and other locations.

Views on Food: Outsmarting the Drought

Shahar Caspi tends acres of gardens, fruit trees and a commercial vineyard in the hamlet of Oregon House in the foothills between Marysville and Grass Valley. His job since 2012 has been raising food year round for his community and bringing perfect wine grapes to harvest – all without tilling, and with little to zero added water.

We drove between two fields, one side brown, ragged and parched, the other a Caspi no-water showcase – grape vines in bud break, the ground beneath them rich, a natural ground cover green as jade.

“Mulch with shredded roots,” he says exuberantly, eyes off the road. “Very simple!”

At a sunny glade, another concept preps cherry trees. He walks us past huge square holes he flushed with water and allowed to drain. The holes were filled with Caspi’s mulch, manure and compost, then a tree. “They won’t need water for many, many months.”

Back in the greenhouse next to his mountaintop home, Caspi laid manure on the rock-hard dirt floor, and on purpose didn’t till the soil underneath. He stuck chard seedlings directly into the manure. “They flourished immediately,” Caspi says. “The roots went sideways into a huge mass of roots. I’ve never seen anything like it.”

And despite no rainfall the first four months of his second season of raising food for his neighbors, water usage dropped 30 percent and yields increased.

How does he do it?

The same way a dietitian would bulk up a wasting patient with lots of calories and nutrients. Except Caspi is like a soil chef, mixing fermented manure and compost in varying proportions “to re-establish a whole layer of soil that holds water” like a subterranean sponge.

The technique is reminiscent of Rudolf Steiner’s bio-dynamics, which treats the farm as a holistic entity. But considering Caspi’s past and combining it with an uncertain future of water in California, a goal of using zero water to grow food is understandable.

Caspi grew up inculcated with respect for water. In Israel, kids get “Don’t Waste A Drop” stickers in school that go on the family fridge. “It’s so much in our blood to save water,” he says. “We had a cartoon that showed the whole family showering together under a few drops of water.”

Modern drip irrigation with emitters was an idea out of Israel. So is placing black plastic sheeting over soil to contain moisture. Israel leads the world in recycling 80 percent of its water. Its latest technology collects dew.

In California, some growers are on top of the drought. A report from the California Farm Water Coalition says that in the San Joaquin Valley $2.2 billion was invested in drip irrigation on 1.8 million acres. But for every conserver using soil probes, infrared photography and improved weather forecasting, we have devourers of resources.

“Here you flood fields,” Caspi says. “An Israeli would say, ‘Are you kidding?’ It’s the mentality of abundance, that it’s going to last forever.”

In 2008, winemaker Gideon Beinstock hired Caspi to be vineyard manager at Renaissance Vineyard and Winery in Oregon House. With Caspi’s degree in plant sciences from The Hebrew University and years of experience in water strategy in Israel, his mission was to convert 45 acres of conventionally cultivated vineyard to fully bio-dynamic viticulture.

Production costs went down by 12 percent. Yields increased between 3 percent and 7 percent.

Beyond his work at the vineyard, Caspi tends the gardens of about 50 “member” neighbors in and around Oregon House. Because this is a rural community, Caspi can put a sign on the road saying “manure needed,” and loads are brought to him for fermenting.

The finished manure plus organic matter from garden waste, wood ash and olive paste all come from within a 10-mile radius. It returns to the members in the form of Caspi’s magical soil smoothie that retains water and nourishes roots.

In the garden, take a load off and don’t till. Then follow Caspi’s instructions.

Find a source of manure and compost. Lay a thick layer, up to 4 inches, on the ground and plant right into it. Apply plant by plant rather than over the entire garden. For tomatoes, dig a deep hole, water the hole until the water drains, fill the hole with a mix of chicken manure and compost, then a tomato seedling. Add a bit more nitrogen in the form of half a teaspoon of chicken manure when you dig the hole. Water once more.

How long can you go without added water? A week? A month? Water only if lack of moisture is detected by sticking a finger into the ground. “The first year is hardest,” Caspi says. “Don’t give up. If you fail, you try again.”

As to your own sense of food security, you can have a community-supported agriculture system on your street. “One person grows the potatoes, someone else grows the beans, and another person grows herbs,” Caspi explains. Everyone adds to the pile tended by the neighborhood compost geek. In a few years, the soil will be so absorptive it will gulp winter rainwater and retain it through summer.

Without access to the livestock that live near Caspi, there might be a cost for store-bought manure, unless you have a friend with a horse, a cow or chickens. When a crop is ready, deliveries begin in staggered availability.

With wells already stressed in the Sierra foothills, Caspi remains an Israeli at heart, tinkering for extra droplets of water in what he presumes is a terminal drought.

“The plant takes only what it needs,” Caspi says. “This is how it works in nature. If you don’t need it, why do you want to take it?”

To protect ourselves from food shortages and to buffer California’s agricultural economy, we all should regard any adjustments that allow us to grow food with less water as permanent.

From Service to Harvest – Military Veteran Deploys Aquaponics on the Farm

Farming wasn’t Vonita Murray’s first choice, but after making a drastic career change, the 38-year-old Navy Veteran, former office manager and longtime fitness enthusiastic now believes digging in the dirt, growing food and being her own boss may be the dream job she has always wanted.

The transition to farming for Murray, 38, happened gradually over the past several years. She eventually took stock of her life, sized up her talents, sharpened the focus on her dreams and decided she was no longer cut out for a desk job.

For several years, Murray had been an office manager and a CAD, or computer-assisted design, technician for an architecture firm. Much of her work focused on remodeling floor plans for a major fast food chain’s Northern California stores. But when the economic downturn hit the architecture and design industry, Murray got laid off. She saw it as a chance to make a change in her life.

“It was the best thing that ever happened to me,” she said.

Using a $5,000 grant she received from the Davis-based Farmer Veteran Coalition, Murray bought some basic farm equipment and managed to launch her new career. She also enrolled in the first class of the California Farm Academy, a six-month farming course run by the Center for Land-based Learning in Winters.

Murray knows it will take hard work and several years before she can make a comfortable living as a farmer. But she has a long-term plan and says farming – including many 12-hour days – is exactly the lifestyle she was seeking.

“I’ve never been so tired, so broke and so happy,” she said with a laugh. “For the first time in my life, I have worth and a purpose. What I do has value in people’s lives.”

More and more veterans are turning to farming to connect in a similar way. “We’re all a family and we all try to help each other succeed,” Murray said.

When Michael O’Gorman founded the Farmer Veteran Coalition in 2009, he searched throughout the U.S. and found just nine veterans interested in going into farming. By the end of that year, the number was up to 30. These days, O’Gorman and his group have helped 3,000 veterans transition into farming.

“What’s really attracting veterans to agriculture is it offers a sense of purpose and a sense of mission,” said O’Gorman, who has farmed for 40 years. “It’s about feeding their country, offering food security and a better diet.”

O’Gorman is seeing more women get into farming and says Murray is a great role model.

“Vonita is dynamic, creative, energetic and smart. Whatever she does, she will do it well and take it places,” he said. “She’s a growing phenomenon. About 15 percent of those who serve in the military are women and that’s about the same percentage we hear from.

More and more women are going into agriculture. The military and farming are both male-dominated. The women who have taken on both of them just seem like a really exceptional group.”

Those who encounter Murray are often impressed by her energy and her holistic, lead-by-example approach to farming. Not only does she want to grow good food, she sees the work she does as a way to help people be healthy.

Indeed, Murray’s physical presence says plenty. Though she no longer trains as a bodybuilder, she remains noticeably lean and muscular. Her workouts these days focus on functional training and she is a big advocate of Crossfit, which combines classic weightlifting with mobility exercises.

“I’m doing all this because I want to get people healthy,” said Murray, noting that she hopes to someday build an obstacle course on the property so people can use it to work out.

She also has a penchant for unorthodox and innovative approaches to growing food. Standing on a portion of the land she leases in rural Elverta next to the renowned Sterling Caviar facility, Murray watches water stream past. It’s runoff from the tanks where sturgeon are raised for their prized caviar. It’s also the key to what she will grow on her new “farm” site.

Murray essentially harnesses the water, 3 million gallons a day and loaded with nutrients, to create an innovative style of growing food called aquaponics, which combines modern hydroponics with forward-thinking environmental awareness.

The water goes through a settling pond to separate solids from liquids, travels through a moat and into small ponds where Murray is growing produce she sells to restaurants and to a growing number of customers at the Saturday farmers market in Oak Park.

The outgoing and optimistic Murray has put some of her energy into tapping resources that can help get her going in farming. She obtained a $35,000 low-interest loan from the U.S. Department of Agriculture.

Murray, whose produce operation is going to specialize in watercress, says she would have been at a loss as to how to proceed as a farmer without the education she got at the California Farm Academy. The program costs about $2,600 and various grants subsidize the tuition, according to Dawnie Andrak, director of development for the Center of Land-Based Learning.

Those who enroll run the gamut of age and work background. About 20 students graduate each year. To make it a real-world experience, they write a business plan and present it to a panel composed of people from the banking, business and farm community.

“There are more women like Vonita getting into farming,” Andrak said. “You will not find someone more dedicated and more clear about what it is she wants to do. She is certainly not one to give up.”

Jennifer Taylor, the director of the Farm Academy, is herself an example of a woman who made the career leap into farming. She was a research biologist who had no idea until well after college that a life in agriculture might appeal to her. She landed a four-month internship on a farm, was given four calves and eventually rented a barn and started dairy farming.

“If you have no connection to agriculture, it’s very difficult to imagine yourself doing it, Taylor said. “It’s a way many people want to live, an opportunity to be your own boss, work outside with your hands and be your own boss.”

But can you make a living?

“That depends,” said Taylor, noting that one young farmer from the program now sells to about 50 Bay Area restaurants and nets about $75,000 a year.

Back in Elverta, Murray is busy tending her crops and her chickens. She’s not making a profit yet, but she knows it takes time. More than anything, she loves the work, the lifestyle and the mission. She sometimes feels the stress of having debt and not knowing whether her crops will thrive.

But her farm is called Thrive Acres for a reason.

“You have to keep dreaming,” she said with a smile. “This is just the beginning.”

CAPCA’s Terry Stark: Biopesticides More Mainstream

Stark Speaks About CAPCA and its Role in the Biopesticide Industry.

Terry Stark, President and CEO of California Association of Pest Control Advisors (CAPCA,) told 140 attendees at the Biopesticide Industry Alliance semi-annual early April meeting in Sacramento, what his organization thinks about the softer pest and disease control products.

“CAPCA represents 3,000 members of the 4,000 licensed-PCAs in California.

We have expanded our educational outreach through CAPCA-ED. We run 40 seminars annually throughout the state to aid all license-holders to improve their categories,” Stark announced,” said Stark.

“The regulatory burden pushes us to be better and more advanced,” Stark said. “CAPCA has 16 chapters, and each chapter has a director seated on the state board. My Chairman of the board is Jeremy Briscoe a Certis USA national manager. So I believe CAPCA is very well integrated with the biopesticide industry. Jeremy is the first representative that is a non-retail, non-independent to serve as the chair of CAPCA. This is a big move in the mentality of what we do,” said Stark.

CAPCA has traditionally centered on the San Joaquin Valley – production agriculture – the heart and soul of diversified agriculture and the money. “However, in the last 10 years, the wine industry has taken a step higher than the our other crops. All of a sudden we have Napa, Sonoma, Paso Robles, and southward to Santa Maria and Ventura County.”

Stark explained that everything west of I-5 tended to be the “softer side” of PCAs and chemical use in California. “I say that with respect because the wine industry was looking for ways to use less conventional products, ways to brand both organically and sustainability and with lower tolerances for their products. That caught on solidly seven or eight years ago.” Stark continued, “My largest independent PCAs are between Mendocino and San Francisco.”

“Like my Ventura guys and gals, they use more biological controls by releasing a lot of beneficials,” said Stark. “And it’s hard to come in with a hard-core application and maintain your beneficial populations,” he said.

When Stark was asked to speak at the Biopesticide Alliance meeting, he was asked to talk about perceptions. “I reflected on what I saw as a manager when they hired me to come to CAPCA. You talk about perception of biopesticides, with all due respect to my membership, 30 percent think that it’s one way or the highway.

In the central part of the state, from Kern County and throughout the desert valleys, it’s still spray and run. It’s big business, big acres. But it has its place,” said Stark.

He spoke about California being a hodgepodge of the most invasive species in the world, with many new pests coming in seemingly every week.

“Our entire citrus industry is facing Asian Citrus Psyllid which vectors the deadly citrus greening disease; we just survived the Glassy-winged sharpshooters in the wine industry; and, we’ve got Shot-hole bores coming to avocados. This represents huge production areas,” he said.

CAPCA has recognized that there are new ideas in pest and disease control and has moved towards being able to incorporate other chemistries, pheromones, and other items into the tool chest.

 

CAPCA’s Aging Demographics

Stark shared some demographics of CAPCA. “In CAPCA meetings, I don’t see a lot of dark-haired people sitting in the room. I don’t see a lot of females sitting in the room.

Our gender is 10-15 percent females,” he said.

Seventy five percent of my membership has 16-plus years of experience as PCAs. CAPCA also manages 1,000 Certified Crop Advisor (CCAs) who focus on nutrient recommendations, and the same demographics carry over to them. Of that, 35 percent have 30-plus years of experience. Do you think many will work past 30 years?

CAPCA’s last membership survey was done in 2010. We are projecting a 20% loss of membership by 2015. And that continues outward in a five-year cycle.

Through the Department of Pest Regulations we are only testing maybe 12-15 percent maximum replacements with young PCAs coming into the cycle.

How do we survive? We are turning to electronics, iPhones, and iPads.

PCAs have to be licensed in California if you are using restricted-use materials, soliciting for sale, and/or acting as an expert thereof. That takes care of the whole sales group too.

So, in biopesticides, you’re outside of that umbrella in most ways. You have some products that you to play with, but overall, that gives a “softer approach” for the younger PCAs to look at.

 

 Working Areas of PCAs

Sixteen percent of PCAs work in field and row crops; 34 percent in trees & vines, the only ones getting water this year; vegetables at 12 percent; and turf and ornamentals –10 percent. Turf and ornamentals in California drop 50 percent in the last 5 years with the collapse of the housing and commercial real estate industries, plus golf courses, they have had a pullback. So our members have moved to retail and other areas.

If you are in PAC and you are in retail, you represent 30 percent of the industry. Eighteen percent are independents, and that means you truly do your own thing: if you have alfalfa, you have 20,000 acres you’re looking at; if you have citrus, you’ve got 3-5,000 acres; if you have vineyards, you’d better have 2-3000 acres to pay for it—if you want to make big money—and you’re working 7 days a week to do that. Seventeen percent are in-house; these are the Paramount’s and the Boswells of the industry. They hire CCAs and PCAs like full-time employee of the ranch.

The dynamics of I-5 is not moving into the Central Valley or into the southern counties. You have pockets of Los Angeles and Santa Barbara where you have nursery stocks, that‘s always been kind of open to the biopesticides industry and its products.

What I think has made the biopesticide industry successful, beyond all of your research, hard work and marketing, are the opportunities and the new wave of using your thumbs, and twitter, and communications, and Facebook, and social media in general. The outreach that you can do your business on the iPhone and still drive down the road, answering your clients’ questions has enabled the “boutique” industry in the last 5 years to come closer to the mainstream because customers don’t have to do any special work to find out about you. You are in their feed lines of information. These are important tools,” said Stark.

“California is a highly-regulated environment, so electronics has complemented other resources. I think the known fact that many products are less toxic is a huge benefactor,” he said.

“Take the Light Brown Apple Moth, which ended up being a environmental community PR campaign that kicked food and agriculture’s butt in California. And now every fruit tree in Santa Cruz is going to die from the apple moth. You can’t even move the firewood because it will contaminate the rest of the area,” Stark said.

The unknown elements of a pheromone to treat the moth were a big problem because the public did not understand, and the industry took it for granted. “The pheromone is about as soft and appropriate as you can get in the marketplace,” said Stark. “But we need to approach the public in a different way. And I think the biopesticide industry is doing a much better job,” he said.

“I’d be remiss with all of the large companies sitting in the room, the BASF’s, Syngenta’s, Bayer’s, the Valent’s—all have learned to adopt and bring into their tool chest additional products that can complement their conventional materials and usually make the grower more profit,” noted Stark.

“CAPCA doesn’t get into this much, but we have a lot regulatory obligation responsibility to protect the field worker. The toxicity and the life of the product go a long way in how you get back into the field,” he said.

“So, in the biopesticide world, you have a better opportunity of targeting the exact pest you need to target. It’s not a broad-spectrum-type deal. So that gives you the advantage. My PCAs see that– my 50 percent younger side in the house – sees that. And that’s a positive for this industry,” Stark said.

IPM is not a word that is understood until you get to California. CAPCA cannot do anything in his recommendation without being CEQA-oriented (California Environmental Quality Act) must look for alternative uses before any restrictive material can be made; otherwise he is in violation of his own recommendation. IPM, and biopesticide products fit that requirement to make that check mark when they do that.

“In addition, biologicals are lower priced than they ware 7-8 years ago. And that’s good because the grower doesn’t spend a dime more than they have to. If you think PCAs are out there pounding product or fertilizer on, and the farmer is not making any money, just three minutes later in the coffee shop, that guy is fired and another is hired,” Stark said.

“It is important to the sustainability in going forward, when you have a regulatory environment like we do in California. We have a built-in arena here and people are always listening to what can be done better and still make a profit. In my opinion, you are off to the races and biopesticides are mainstream now,” noted Stark.

If you can hit 15-20% of the marketplace, it’s been a great quarter-century run for you to get there and I think the CAPCA membership is looking forward to a long-lasting relationship.

HOUSE POSTPONES ACTION ON AGRICULTURAL APPROPRIATIONS BILL

The House this week began considering the fiscal 2015 funding bill for Agriculture, Rural Development, Food and Drug Administration, and Related Agencies, but postponed a final vote on it so that Republicans can sort out their leadership issues in the wake of Majority Leader Eric Cantor’s decision to step down from his post after losing his primary election for the Virginia 7th Congressional District seat. The legislation includes $20.9 billion in discretionary money, which is equal to the fiscal 2014 level, and $121.3 billion for mandatory spending for federal food programs. NPPC helped secure in the House Appropriations Committee-approved bill language that prohibits USDA from implementing certain burdensome provisions included in the 2008 Farm Bill related to the buying and selling of livestock under the Grain Inspection and Packers and Stockyards Act. Additionally, Rep. Tom Latham, R-Iowa, requested and was able to include funding for research on porcine endemic diarrhea virus (PEDv) funding to better understand the transmission of the disease. NPPC is thankful of Rep. Latham and Appropriations Committee Chairman Robert Aderholt, R-Ala., for the inclusion of these important funds.

 

LIVESTOCK HAULERS RECEIVE ONE-YEAR EXEMPTION FROM DOT ‘HOURS OF SERVICE’ RULE

The U.S. Department of Transportation last Friday granted truck drivers hauling livestock and poultry a one-year exemption from an hours-of-service rule that took effect last July 1. The regulation requires truck drivers to take a 30-minute rest break after eight hours of service. For drivers transporting livestock and poultry, the hours of service included loading and unloading animals. NPPC hailed the move as a victory for animal welfare, as summer temperatures can cause livestock health problems, particularly for pigs, which do not sweat. NPPC is also appreciative of Secretary of Transportation Anthony Foxx for recognizing the importance of the issue for livestock farmers and Agriculture Secretary Tom Vilsack for his efforts to secure the exemption. HOUSE COMMITTEE HOLDS HEARING AFTER COMMENT EXTENSION GRANTED

NPPC Chief Environmental Counsel Michael Formica drafted a petition signed by 72 other agricultural groups in support of an extension. Under EPA’s proposal, the agency would redefine the term “waters of the United States” to include intermittent and ephemeral streams, and expand jurisdiction into farm fields and farm drainage. This would significantly impact agricultural operations, requiring permits and giving activists and regulators authority to dictate farm production practices. Prior to issuing these extensions, NPPC hosted EPA representatives at the World Pork Expo to meet with the NPPC Board of Directors and learn firsthand about farming. EPA visited farms in North Central Iowa to better understand farmers’ concerns regarding the apparent impact of these proposals and the need to work together with farmers to clarify EPA’s intent and minimize the unintended impacts on farmers and ranchers who have worked their families land for generations.

 

SMALL BUSINESS EXPENSING LEGISLATION APPROVED

The House Thursday approved on a 277-144 vote H.R. 4457, the “America’s Small Business Tax Relief Act of 2014,” which would permanently extend the tax code’s small business expensing provision – Section 179 – at a level of $500,000. Since 2003, Congress increased the amount of investment that small businesses can expense from $25,000 to $500,000. Legislation expanding and/or extending the provision was enacted eight times, but the expensing limits were temporary, and, beginning in 2014, the amount reverted to $25,000. NPPC joined dozens of other agricultural and business organizations in urging House lawmakers to approve the tax legislation. In a June 9 letter to bill sponsors Reps. Pat Tiberi, R-Ohio, and Ron Kind, D-Wis., the groups said permanent extension of Section 179 would increase investment and jobs, reduce tax complexity and paperwork and alleviate uncertainty for business owners, farmers and ranchers.

 

SENATE AGRICULTURE COMMITTEE HOLDS HEARING ON CHILD NUTRITION PROGRAMS

The Senate Agriculture Committee Thursday held a hearing titled “A National Priority: The Importance of Child Nutrition Programs to our Nation’s Health, Much of the discussion focused on the military turning away recruits and discharging service members because of poor health (known as the “Too Fat to Fight” epidemic) as well as on how reduced school lunch programs help students perform better in school. Witnesses included U.S. Air Force (Ret.) General Richard Hawley; National Parent Teacher Association President Otha Thornton; Dr. Stephen R. Cook, associate professor at the University of Rochester Medical Center School of Medicine and Dentistry; and Francis Scott Key Middle School Principal Yolanda Stanislaus. Congress is in the beginning stages of reauthorizing the national school lunch program, and NPPC continues to promote pork as a lean healthy protein that should continue to be included in school lunches.

 

HOUSE WAYS AND MEANS TRADE SUBCOMMITTEE HOLDS AGRICULTURE TRADE HEARING

The House Ways and Means Subcommittee on Trade Wednesday held a hearing titled “Advancing the U.S. Trade Agenda: Benefits of Expanding U.S. Agriculture Trade and Eliminating Barriers to U.S. Exports.” In his opening remarks, Chairman Devin Nunes, R-Calif., voiced his concern that Japan was not being held to the standards that the Trans-Pacific Partnership (TPP), a 12-nation free trade agreement (FTA) of Pacific Rim countries, set out to meet. “If any countries insist on retaining tariffs, then we must complete the negotiations without them and allow them to rejoin when they can commit to full tariff elimination,” said Chairman Nunes. Japan continues to demand certain products, including pork, be excluded from tariff elimination. In addition to being the largest value market for U.S. pork exports ($1.89 billion in 2013), Japan is the fourth largest market for the rest of U.S. agriculture, which shipped $12.1 billion of food and agricultural products to the island nation in 2013. A final TPP agreement that does not eliminate all tariffs and non-tariff barriers on U.S. pork products will negatively affect U.S. pork exports for the next 20 years, meaning billions of dollars less in U.S. pork sales and tens of thousands fewer U.S. jobs. For NPPC to support a final TPP agreement, Japan needs to eliminate all tariff and non-tariff barriers on U.S. pork and pork products NPPC expressed its concerns to the subcommittee in written testimony. DR. GAMBLE PARTICIPATES IN CODEX WORKING GROUP

Dr. Ray Gamble, president ex officio of the International Commission on Trichinellosis, traveled to Tokyo, Japan, May 28-30 to participate in meetings as part of the Codex Committee on Food Hygiene’s physical working group tasked with drafting a document on parasites in food. Dr. Gamble provided invaluable expertise to the US Delegation which was led by the United States Department of Agriculture’s Food Safety and Inspection Service (FSIS). Currently, some trade partners such as the European Union and South Africa impose unnecessary trichinae mitigation steps on the United States’ pork industry.  According to Dr. Gamble’s studies, there is virtually no risk for trichinae in the United States. A Codex document that creates counterproductive international standards on parasites would be burdensome on the U.S. pork industry. NPPC looks forward to working with FSIS as this document develops.

 

NPB’S LARSEN TRAVELS TO FINLAND

Steve Larsen, National Pork Board’s Director of Pork Safety, traveled to Kirkkonummi, Finland, June 4-6 to participate in an informal scientific colloquium of researchers/university academics, industry and government officials to hear how countries use Hazard Analysis & Critical Control Points (HACCP) and their issues. The committee is planning to propose a new work item aimed at updating the Codex Alimentarius’s General Principles of Food Hygiene, more specifically its Annex on HACCP. The group of HAACP experts will draft a discussion paper on if there is a need to make revisions and will present their findings at the next CCFH meeting this November.

Crystal Creamery of Modesto Launches Campaign Against Theft of Milk Crates

A Modesto-based dairy company has had enough of milk crate theft, which costs the U.S. industry an estimated $80 million a year.

Crystal Creamery, formerly known as Foster Farms Dairy, is working with law enforcement, grocers and other partners to combat the problem.

They are focusing mainly on large-scale thieves who try to sell the ground-up plastic to recyclers, although it’s also illegal to take a single crate for use as a toolbox or storage container.

“Milk crates have always disappeared, but in the last two or three years, the rate of disappearance is greater,” said Elliot Begoun, vice president of sales and marketing at Crystal.

He said the thefts have increased with the rising value of scrap plastic, which is based in part on the price of the petroleum used to make virgin plastic.

Begoun talked about the problem during an interview Tuesday at the Kansas Avenue headquarters of the company, still owned by the Foster family, which also is in the poultry business.

On a typical day, Crystal trucks haul about 60,000 crates filled with milk, sour cream and cottage cheese to grocery stores and food service customers from Bakersfield to the Oregon border. The drivers are supposed to bring back crates from previous deliveries, but they can be stolen if not secured at the customers’ locations, Begoun said.

Each time that happens, Crystal loses about $4, which is hard to take in an industry with tight profit margins, he said. Nationwide each year about 20 million crates are stolen, according to the International Dairy Foods Association.

Crystal is working with grocers on improved security, as well as with food banks, which sometimes get donations of dairy products in the crates.

The company also approached Stanislaus County Sheriff Adam Christianson. He said Tuesday that the crime is driven mainly by addicts looking for recycling income they can spend on drugs, similar to metal theft.

Christianson said he was surprised that the scrap value of plastic has risen so much. He noted other such commodities that are being stolen, such as used grease from restaurants, which rendering companies buy.

“Milk crates are no different,” the sheriff said. “It’s a material that can be recycled.”

Christianson said he is asking detectives to look into where the stolen crates are being ground up and recycled. They’re molded to include a warning against unauthorized use, and their distinctive appearance makes it hard to sell them intact.

The Institute of Scrap Recycling Industries warns member companies against accepting materials “that are clearly marked as property belonging to an entity other than the seller, such as beer kegs, milk crates and other marked materials.”

Crystal also is asking the public to resist the temptation to take a small number of crates for personal use. Begoun and Larry Diggory, director of food operations at the plant, said they have seen them used in retail displays, on the back of motorcycles and on plumbers’ trucks.

“What we’re trying to do is to create an awareness with the public that it’s theft and it’s a cost of business,” Begoun said.

Housing Market Recovery Helps Timber Producers

Home construction in California is on the upswing as the housing sector slowly recovers from the dramatic downturn of the recession that saw home prices and new construction plummet.

Going hand in hand with the increase in home building is the demand for lumber for framing, moldings, doors, fences and other uses. California timber producers say they welcome the increased demand for lumber, but are held back by the regulatory climate in the state that cuts into their bottom line.

As a result of added costs and restrictions on timber harvest, California forestry owners say they have difficulty competing with their counterparts in Washington, Oregon and British Columbia who work in a more business-friendly climate.

An estimated two-thirds of the building materials utilized in California comes from the Pacific Northwest and Canada’s westernmost province.

“Lumber production in California has dramatically fallen off from where we were a couple decades ago,” said Mark Pawlicki, director of corporate affairs for Sierra Pacific Industries in Anderson. “We are harvesting around 1.4 billion board-feet of timber now in California, and that is less than half of what it used to be. A lot of the fallout has been because of the reduction in sales of timber in national forests. It is a combination of regulations involved and a philosophical change within the U.S. Forest Service that occurred back the 1990s.”

Timber owner Peter Bradford of Booneville, who serves as board liaison to the California Farm Bureau Federation Forestry Advisory Committee, said the high cost of regulations “adds a substantial amount” to the price of California timber.

“We are very over-regulated when compared to Washington, Oregon or British Columbia,” Bradford said. “There is a lot of material that comes in from Oregon and Washington because the cost to get a harvest plan to log the trees is easier and much less costly than it is here. It is time, paperwork and cost here in California.”

Despite these challenges, timber owners in California say they are more optimistic than they were a few years ago, when the market for timber had decreased significantly.

“Prices right now aren’t the greatest, but they are better than they were five years ago. For some of the redwood that we are selling this summer, we’ve been given a price of around $900 for 1,000 board-feet. Back in the heyday of the late 1990s, we were receiving $1,500 for that same amount of lumber,” Bradford said.

Pawlicki noted that lumber is a cyclical market.

“As everyone knows, housing construction has been way off in recent years, but it has been gradually coming back. We have seen improvements in U.S. housing construction and along with it improvements in lumber pricing,” he said.

There are currently about 30 lumber mills in California, a decline of 80 mills since the 1990s.

“With the downturn that we experienced in lumber demand, a lot of sawmills closed in California and we are roughly in balance now with supply and demand,” Pawlicki said. “As demand goes up, we expect to see some pricing increases for lumber—not dramatic, but nevertheless steady. And that helps us to maintain our industry here in California.”

Producing more lumber in California to meet the state’s demand, he said, would require “some significant changes in the regulatory world.”

“Folks are not too inclined to build a new sawmill in this state with the regulatory environment that we have,” he said.

Another concern is the tight labor supply, particularly for employees who are experienced in timber harvest and millwork.

“Labor is a tremendous issue in the timber industry right now, trying to get people who are able to do the work,” Bradford said. “This is frequently something you are born into and you know how to do it.”

The labor shortage is felt most acutely in the mills, according to Pawlicki.

“We are experiencing some difficulty filling jobs, particularly millwrights and technical folks in our mills. These mills now are very technical and computerized systems for sawing lumber. It requires a different skill-set than what was required in the past,” he said.

The California drought creates concerns for foresters for several reasons, including increased fire danger and a slowdown in tree growth that corresponds to the lack of water for the trees’ root systems.

“The drought stresses the trees and we will see some tree die-off. We are concerned that we may lose a lot of trees to drought—and when that happens, insect infestations occur and that kills even more trees, and this creates an increased concern for catastrophic wildfires,” Pawlicki said.

Bradford said wildfire concerns also build because of the problems that small landowners face in trying to harvest their timber.

“The amount of environmental review that they have to go through to get a timber harvest permit and the cost to get that review done, with the market value of timber now, makes it economically undesirable. As a result, some of these properties are being sold for home sites. With this increased population comes an increase in the fire danger,” he said.

Bradford said he has seen a buildup in understory in the forests—shrubs, bushes and grasses—that has created dangerous fire conditions.

“That is the worst part of it. The other thing, of course, is that without the normal amount of rainfall, the trees won’t grow as fast as usual. But that is something that is pretty hard to measure,” he said.

Despite the ongoing challenges facing the timber business, Pawlicki noted some positive signs.

“We are optimistic that the market is going to improve domestically. We are seeing some improvements in operating conditions in California, and we are seeing some improvements in the legislative and regulatory front that have helped us,” he said.
